Despite the daily occurrence of theft within Massively-Multiplayer Online Role-Playing Games and virtual worlds, this type of theft remains unregulated in the United States. This Comment takes the position that not only should the United States prosecute the theft of virtual goods under current theft penal statutes, but also that such approach is desperately needed given the economic prominence of virtual goods and the increasing rise of virtual good thefts. This Comment demonstrates how the current United States legal system could classify the theft of virtual goods as legally cognizable theft, while considering: (1) whether virtual goods can be considered property; (2) if virtual goods are property, what property rights players need to protect virtual goods from theft; and (3) whether existing legal provisions are sufficient to protect the theft of virtual goods, taking into account arguments against their application. This Comment also considers whether other regulatory schemes, including those of other countries, would better address the theft of virtual goods, and concludes that penal statutes would regulate the theft of virtual goods most effectively.

Green assesses our legal framework at a time when our economy commodifies intangibles (intellectual property, information, ideas, identities, and virtual property) and theft grows more sophisticated.

It has often been said that information is power. This is more true in the information age than ever. The book profiles the tools used by criminal law to protect confidential information. It deals with the essence of information, the varieties of confidential information, and the basic models for its protection within the context of the Internet and social networks. Eli Lederman examines the key prohibitions against collecting protected information, and against using, disclosing, and disseminating it without authorization. The investigation cuts across a broad subject matter to discuss and analyze key topics such as trespassing and peeping, the human body as a source of information, computer trespassing, tracking and collecting personal information in the public space, surveillance, privileged communications, espionage and state secrets, trade secrets, personal information held by others, and profiling and sexting. Infocrime will appeal to graduate and undergraduate scholars and academics in the legal arena, in law schools and schools of communication, and to practicing lawyers with an interest in legal theory and a concern for the protection of the personal realm in a world of increasingly invasive technologies.

Virtual and augmented reality raise significant questions for law and policy. When should virtual world activities or augmented reality images count as protected First Amendment ‘speech’, and when are they instead a nuisance or trespass? When does copying them infringe intellectual property laws? When should a person (or computer) face legal consequences for allegedly harmful virtual acts? The Research Handbook on the Law of Virtual and Augmented Reality addresses these questions and others, drawing upon free speech doctrine, criminal law, issues of data protection and privacy, legal rights for increasingly intelligent avatars, and issues of jurisdiction within virtual and augmented reality worlds.

Now in its second edition, Cybercrime: Key Issues and Debates provides a valuable overview of this fast-paced and growing area of law. As technology develops and internet-enabled devices become ever more prevalent, new opportunities exist for that technology to be exploited by criminals. One result of this is that cybercrime is increasingly recognised as a distinct branch of criminal law. The book offers readers a thematic and critical overview of cybercrime, introducing the key principles and clearly showing the connections between topics as well as highlighting areas subject to debate. Written with an emphasis on the law in the UK but considering in detail the Council of Europe’s important Convention on Cybercrime, this text also covers the jurisdictional aspects of cybercrime in international law. Themes discussed include crimes against computers, property, offensive content, and offences against the person, and, new to this edition, cybercrime investigation. Clear, concise and critical, this book is designed for students studying cybercrime for the first time, enabling them to get to grips with an area of rapid change.
