Com a centralidade recentemente assumida pelo plano de insolvência, impõe-se indagar se existem - e com que extensão - deveres que vinculem os credores entre si e perante a empresa insolvente, bem como entre os sócios e da empresa perante estes. Questiona-se, nomeadamente, se regras como a Obstruktionsverbot alemã, que permite ficcionar o voto de credores que atuem abusivamente, deverão ser transpostas para Portugal. Defendemos que, apesar da inexistência de vínculo específico entre os credores da insolvência, estes estão vinculados entre si por deveres mais profundos do que o dever geral de respeito. Esses deveres apresentam utilidade na resolução de problemas concretos, como a votação por credores concorrentes, a votação em conflito de interesses e na resolução do problema do empty crediting.
