Son los primeros resultados de una discusión sobre Jueces y Ciudades que, bajo el ausipicio de la PAOT, ha emprendido la rama latinoamericana del Grupo Internacional de Investigación sobre Derecho y Espacio Urbano (IRGLUS, por sus siglas en inglés), que forma parte de la Asociación Internacional de Sociología del Derecho (RCSL). Mientras Buenos Aires vive un activismo judicial sin precedentes en el caso del Riachuelo, en otras partes los conflictos se procesan todavía por vías extra-judiciales. Unos jueces tratan de no "entrar al fondo" de los asuntos, porque para eso está el gobierno, mientras otros esperan con ansias la oportunidad de suplirlo; y otros más que dan impedimentos, como en la era autoritaria, por la fuerza de los otros poderes del estado. El Estado Social sigue en crisis. Ha empezado a estar en crisis desde quizá el momento mismo en que, paradójicamente, gozaba de legitimidad. El Estado de la justicia social ha nacido cuestionado (e impugnado) por aquellos sectores del derecho, de la economía y de la política que flamean hipócritamente la bandera del Estado mínimo. Vivimos en un escenario mundial de profundización de un capitalismo salvaje, insostenible y suicida, y de una imparable deslegitimación de la clase política y de la democracia, sumado a altas tasas de corrupción política y financiera, nacional e internacional, y enormes dosis de cinismo generalizado desde los grandes organismos financieros internacionales e incluso de algunos que pregonan la supuesta defensa de los derechos humanos. A la vez, surgen nuevos actores sociales en este teatro social mundial de autoritarismo político, de conservadurismo moral, recortes y violaciones de derechos humanos sociales, económicos y culturales, pero también de derechos individuales, civiles y políticos. Nuevos movimientos sociales y políticos, la ciudadanía en génesis democrática hambrienta de justicia social, de derechos sociales y también de libertades ciudadanas, deseosos de refundir nuevos modelos democráticos, coherentemente democráticos, procesal y materialmente igualitarios y libres. This book deals with slums as a specific question and a central focus in urban planning. It radically reverses the official version of the history of world cities as narrated during decades: slums are not at the margin of the contemporary process of urbanization; they are an integral part of it. Taking slums as its central focus and regarding them as symptomatic of the ongoing transformations of the city, the book moves to the very heart of the problem in urban planning. The book presents 16 case studies that form the basis for a theory of the slum and a concrete development manual for the slum. The interdisciplinary approach to analysing slums presented in this volume enables researchers to look at social and economic dimensions as well as at the constructive and spatial aspects of slums. Both at the scientific and the pedagogical level, it allows one to recognize the efforts of the slum’s residents, key players in the past, and present development of their neighborhoods, and to challenge public and private stakeholders on priorities decided in urban planning, and their mismatches when compared to the findings of experts and the demands of users. Whether one is a planner, an architect, a developer or simply an inhabitant of an emerging city, the presence of slums in one’s environment – at the same time central and nonetheless incongruous – makes a person ask questions. Today, it is out of the question to be satisfied with the assumption of the marginality of slums, or of the incongruous nature of their existence. Slums are now fully part of the urban landscape, contributing to the identity and the urbanism of cities and their stakeholders.
