La problemática de los matrimonios de complacencia o conveniencia abarca diversos sectores del ordenamiento jurídico español. La lucha contra la violencia de género debe tener como objetivo prioritario propiciar la eliminación del modelo de pensamiento que defiende la supremacía, posesión y dominación del hombre sobre la mujer. Solo mediante medidas educativas que conduzcan a la supresión de tales patrones de comportamiento se puede erradicar esta grave lacra social que arroja la cifra de más de 1.000 mujeres fallecidas desde que comenzaron los registros en 2003. Entre tanto, el ordenamiento no puede quedar impasible ante este dramático fenómeno y ha de hacerle frente desde un enfoque multidisciplinar. Desde esta perspectiva, el derecho de la responsabilidad civil debe garantizar el abono de una indemnización vertebrada, integral, suficiente y proporcionada a las víctimas de violencia de género. Las sentencias que enjuician los delitos de violencia de género no están concediendo indemnizaciones adecuadas al daño moral de las víctimas, ni están valorando de forma específica el ataque a la integridad moral que la violencia de género supone, ni el sufrimiento padecido durante los años de maltrato. Ello comporta una nueva victimización de las mujeres objeto de malos tratos, pues, de algún modo, la escasa valoración de la dignidad de la mujer, puesta de manifiesto por parte de la Administración de Justicia al conceder una indemnización, en ocasiones ínfima, no hace sino reafirmar al maltratador en su modelo de pensamiento. La autora, Pilar Álvarez Olalla, Catedrática de Derecho Civil en Universidad Rey Juan Carlos, es Directora del Máster Universitario de Responsabilidad Civil, Secretaria de la Asociación de Profesores de Derecho Civil y Magistrada Suplente en la Audiencia Provincial de Segovia desde el año 2003. Con el paso de los años, la dinámica familiar ha ido variando influida por diversos factores, entre ellos la incorporación de la mujer al mundo laboral o el progresivo interés de los padres por participar en las tareas de cuidado de sus hijos, dando lugar a que ambos progenitores hayan ido compartiendo las obligaciones de cuidado, educación y asistencia a los menores. Todo ello conlleva que ciertos sectores de la sociedad hayan demandado la incorporación de la custodia compartida en el Código Civil como una modalidad más de guarda y custodia, implicando una participación conjunta de ambos progenitores. Asimismo, muchos progenitores, individualmente, reclaman una situación de igualdad a la hora de adoptar la guarda y custodia de los hijos; en primer lugar, para poder seguir llevando a cabo sus responsabilidades parentales después del cese de la convivencia y, en segundo lugar, para mantener una relación fluida con los menores. Este trabajo pretende ser una cartografía jurídica de la legislación y jurisprudencia sobre la guarda y custodia compartida en España. Presenta las bondades y deficiencias del sistema e intenta aportar diferentes soluciones a la regulación parcial de nuestro Código Civil. Un buen conducto para salvar esta escasez legal es la más nutrida regulación de las CCAA y las aportaciones jurisprudenciales a los conflictos que se generan día a día. Jésica Delgado Sáez. Nacida en Salamanca en 1991. Licenciada en Derecho, Máster en Derecho Privado Patrimonial y Doctora en Derecho Privado con mención internacional por la Universidad de Salamanca. Since the 1960s, the Catholic Church has acted as a mediator during social and political change in many Latin American countries, especially the Dominican Republic, Bolivia, Guatemala, Nicaragua, and El Salvador. Although the Catholic clergy was called in during political crises in all five countries, the situation in the Dominican Republic was especially notable because the Church's role as mediator was eventually institutionalized. Because the Dominican state was persistently weak, the Church was able to secure the support of the Balaguer regime (1966-1978) and ensure social and political cohesion and stability. Emelio Betances analyzes the particular circumstances that allowed the Church in the Dominican Republic to accommodate the political and social establishment; the Church offered non-partisan political mediation, rebuilt its ties with the lower echelons of society, and responded to the challenges of the evangelical movement. The author's historical examination of church-state relations in the Dominican Republic leads to important regional comparisons that broaden our understanding of the Catholic Church in the whole of Latin America.
