Ese tercero puede ser conciliador que es un mero testigo del posible acuerdo. También puede ser mediador, el cual motiva y aporta ideas para la solución de la controversia. Y por último el árbitro con potestad de dictar un laudo de obligado cumplimiento para las partes en conflicto. Estos medios extrajudiciales vienen regulados y establecidos en nuestro ordenamiento por acuerdos a nivel estatal y autonómico.
