Este libro es el resultado de las investigaciones realizadas, durante el 2018, por la Red de Investigadores del Centro de Investigación en Política Criminal de la Universidad Externado de Colombia, y presentadas en el Congreso Internacional "Presunción de inocencia, libertad y abolicionismo", en el cual se discutieron los efectos y riesgos que tiene el punitivismo en el ejercicio de la presunción de inocencia. Esta publicación pretende generar reflexiones a partir del estudio de casos sobre distintas situaciones que se presentan en el interior de las cárceles colombianas y que atentan contra la dignidad de la población privada de la libertad, en especial la población más vulnerable: los adultos mayores, las mujeres y los indígenas, etcétera. En este sentido, es un llamado a los distintos actores -las autoridades del sistema de política criminal, la academia, los miembros de la sociedad civil, los medios de comunicación, entre otros- para que de manera introspectiva y crítica examinemos la presunción de inocencia no como un principio estático sino como un principio vivo que se manifiesta en las diferentes etapas de la política criminal y cuya mala aplicación tiene graves consecuencias en la dignidad de la población privada de la libertad.

What is a human right? How can we tell whether a proposed human right really is one? How do we establish the content of particular human rights, and how do we resolve conflicts between them? These are pressing questions for philosophers, political theorists, jurisprudents, international lawyers, and activists. James Griffin offers answers in his compelling new investigation of the foundations of human rights. First, On Human Rights traces the idea of a natural right from its origin in the late Middle Ages, when the rights were seen as deriving from natural laws, through the seventeenth and eighteenth centuries, when the original theological background was progressively dropped and 'natural law' emptied of most of its original meaning. By the end of the Enlightenment, the term 'human rights' (droits de l'homme) appeared, marking the purge of the theological background. But the Enlightenment, in putting nothing in its place, left us with an unsatisfactory, incomplete idea of a human right. Griffin shows how the language of human rights has become debased. There are scarcely any accepted criteria, either in the academic or the public sphere, for correct use of the term. He takes on the task of showing the way towards a determinate concept of human rights, based on their relation to the human status that we all share. He works from certain paradigm cases, such as freedom of expression and freedom of worship, to more disputed cases such as welfare rights - for instance the idea of a human right to health. His goal is a substantive account of human rights - an account with enough content to tell us whether proposed rights really are rights. Griffin emphasizes the practical as well as theoretical urgency of this goal: as the United Nations recognized in 1948 with its Universal Declaration, the idea of human rights has considerable power to improve the lot of humanity around the world. We can't do without the idea of human rights, and we need to get clear about it. It is our job now - the job of this book - to influence and develop the unsettled discourse of human rights so as to complete the incomplete idea.

An international manual is like a world cruise: a once-in-a-lifetime experience. All the more reason to consider carefully whether it is necessary. This can hardly be the case if previous research in the selected field has already been the subject of an earlier review-or even several competing surveys. On the other hand, more thorough study is necessary if the intensity and scope of research are increasing without comprehensive assessments. That was the situation in Western societies when work began on this project in the summer of 1998. It was then, too, that the challenges emerged: any manual, espe cially an international one, is a very special type of text, which is anything but routine. It calls for a special effort: the "state of the art" has to be documented for selected subject areas, and its presentation made as compelling as possible. The editors were delighted, therefore, by the cooperation and commitment shown by the eighty-one contributors from ten countries who were recruited to write on the sixty-two different topics, by the con structive way in which any requests for changes were dealt with, and by the patient re sponse to our many queries. This book shows how the overall impact of the penal policy agenda of the Coalition Government 2010-2015 has not led to the intended 'rehabilitation revolution', but austerity, outsourcing and punishment, designated here as 'punitive managerialism'. divThe policy of austerity has led to significant budget cuts in legal aid and court services which threaten justice. It has also led to staffing reductions and overcrowding in the prison system which threaten order and have undermined more positive work with prisoners. The outsourcing of prison and community-based offender services is based on untried method with uncertain results. The shift in orientation towards punishment is regrettable because it is essentially negative. The book notes that this move to punitive managerialism is located in the broader trend towards neo-liberalism.
