Câu 1: Nêu những điều kiện để đảm bảo tính hợp pháp của quyết định kỷ luật sa thải? (4 điểm) Ngày 10/9/2011, ông H được Công ty Liên doanh Mercedes – Benz Việt nam ( sau đây gọi tắt là công ty, có trụ sở chính đặt tại Quận Gò Vấp, Tp Hồ Chí Minh) nhận vào làm việc theo hợp đồng lao động thời hạn 3 năm, công việc phải làm là Tổng quản lý các dự án kinh doanh quốc gia, mức lương một tháng là 2.000USD. Hết thời hạn hợp đồng mặc dù hai bên không kí kết hợp đồng mới nhưng ông H vẫn tiếp tục làm công việc cũ. Ngày 20/5/2015, công ty tổ chức cuộc họp kỷ luật ông H vì lý do “ tham ô” gây thiệt hại nghiêm trọng về tài sản của công ty, vi phạm Điều 6.3 và Điều 9.1.4 Nội quy lao động của công ty và Điều 126 Bộ luật lao động dù không có chứng cứ rõ ràng. Ông H tham gia cuộc họp nhưng đến giữa chừng thì bỏ về. Ngày 15/7/1015, công ty ban hành quyết định sa thải số 684/QĐ do Tổng giám đốc ký, quyết định có hiệu lực kể từ ngày ký. Ngày 25/9/2015. Ông H làm đơn khởi kiện đến tòa án với các yêu cầu như sau: - Yêu cầu Công ty hủy bỏ quyết định sa thải số 684/QĐ - Yêu cầu Công ty phải bồi thường một khoản tiền tương ứng với tiền lương trong những ngày không được làm việc từ ngày bị sa thải đến ngày tòa án xét xử vụ tranh chấp cộng với hai tháng tiền lương, tiền trợ cấp thôi việc và tiền bồi thường tổn thất tinh thần do bị sa thải trái pháp luật. Hỏi: 1. Hợp đồng lao động giữa ông H và công ty trước khi xảy ra tranh chấp là loại hợp đồng lao động nào? (1,5 điểm) 2. Quyết định sa thải của công ty đối với ông H là đúng hay sai? The problem of scale pervades both the natural sciences and the vi sual arts. The earliest scientific discussions concentrate on visual per ception (much like today!) and occur in Euclid's (c. 300 B. C. ) Optics and Lucretius' (c. 100-55 B. C. ) On the Nature of the Universe. A very clear account in the spirit of modern "scale-space theory" is presented by Boscovitz (in 1758), with wide ranging applications to mathemat ics, physics and geography. Early applications occur in the cartographic problem of "generalization", the central idea being that a map in order to be useful has to be a "generalized" (coarse grained) representation of the actual terrain (Miller and Voskuil 1964). Broadening the scope asks for progressive summarizing. Very much the same problem occurs in the (realistic) artistic rendering of scenes. Artistic generalization has been analyzed in surprising detail by John Ruskin (in his Modern Painters), who even describes some of the more intricate generic "scale-space sin gularities" in detail: Where the ancients considered only the merging of blobs under blurring, Ruskin discusses the case where a blob splits off another one when the resolution is decreased, a case that has given rise to confusion even in the modern literature.
