Inhaltsangabe:Einleitung: Unter Wettbewerb wird der wirtschaftliche Leistungskampf auf Märkten verstanden. Aus ökonomischer Sicht kommt dem Wettbewerb die Aufgabe der Gewährleistung einer guten Marktversorgung ZU. Die Versorgung des Marktes wird dadurch erreicht, daß die Unternehmer angehalten werden ihr Angebot an den Konsumpräferenzen auszurichten (Steuerungsfunktion). Dabei besteht der Anreiz Produktionsverfahren anzuwenden, die die Effizienz des Faktoreinsatzes maximieren (Allokationsfunktion) und technischen Fortschritt in der Form von kostengünstigeren Produktionsmöglichkeiten oder überlegenen Produkten zu entwickeln (Innovationsfunktion). Weiterhin gewährleistet der Wettbewerb die optimale Anpassung der Marktteilnehmer an die Datenveränderungen einer dynamischen Wirtschaft (Anpassungsfunktion). Schließlich wird mit Wettbewerb eine leistungsgerechte Einkommensverteilung (Verteilungsfunktion) und die Kontrolle und Begrenzung wirtschaftlicher Macht erreicht (Kontrollfunktion). Aufgrund dieser Funktionen kommt dem Wettbewerb in der sozialen Marktwirtschaft eine zentrale Stellung als Organisationsprinzip der Wirtschaft zu. Nur in den Fällen, in denen Wettbewerb auch durch Maßnahmen der Wettbewerbspolitik nicht gesichert werden kann, ist er durch ein regulatorisches Organisationsprinzip zu ersetzen. Mit der Entwicklung des Wettbewerbsgesetzes haben sich Ausnahmebereiche gebildet, in den man nicht von der Funktionsfähigkeit des Wettbewerbs ausgegangen ist. Diese Branchen wurden von der Anwendung des Wettbewerbsrechts ausgenommen, da man einen Verdrängungswettbewerb mit anschließender Monopolisierung befürchtet. Hierzu wurden die privatwirtschaftlich organisierten Unternehmen durch staatlich regulierte Gesellschaften ersetzt. Typische Beispiele dieser Ausnahmebereiche sind neben dem Verkehrswesen die Telekommunikation und die Stromversorgung. Im Luftverkehr kam für lange Zeit der staatlich dominierten Lufthansa die Rolle des regulierten Unternehmens zu. Im Inlandsverkehr bestand zwar die Möglichkeit privater Konkurrenz, diese wurde jedoch aufgrund von Benachteiligungen bei der Streckenwahl nie realisiert. Im Bereich des internationalen Flugverkehrs nahm die Lufthansa alle deutschen Verkehrsrechte wahr und hatte damit eine Monopolstellung. Erst in Verbindung mit der Deregulierung des amerikanischen Inlandsflugverkehrs wurde die Wettbewerbsfähigkeit des Luftverkehrs wieder in Erwägung gezogen. The development of EU enlargement has raised many thorny issues unanticipated by the framers of the EC Treaty. A significant upshot of these issues is that the concept of European identity – defined in terms of such factors as culture, history and economics – has supplanted the long-dominant theme of ‘widening and deepening,’ particularly since the Union’s expansion has become primarily eastward. The major contribution of this important book lies in its analysis of the conceptualization and perception of enlargement from various points of view, focusing on the concerns of stakeholders and the ‘identity’ conflicts and uncertainties incurred by enlargement initiatives. In the course of its presentation, it details the actual pre-accession Europeanization process and its complex history. Among the key elements discussed are the following: the conflict between ‘widening’ and ‘deepening’ and the effect on EU institutional reform; institutional requirements on candidate countries; pre-accession criteria and negotiations; administrative capacity, judicial capacity, and legal approximation in accession states; capacity of the EU to absorb new Member States; and EC law as part of European identity. Also covered are specific historical details of particular pre-accession negotiations (e.g., Greece, Spain, Portugal, Malta, and Cyprus), the still inconclusive negotiations with Turkey and the Western Balkan states, and political factors involved in the non-accession of Norway, Iceland and Switzerland.
