Inhaltsangabe:Einleitung: In den letzten Jahren tauchen Schlagworte wie Web 2.0 und Social Software immer wieder auf. Was überwiegend im privaten und öffentlichen Raum seinen Ursprung und Erfolg hat, nimmt heute zunehmend Einzug in die Welt der Unternehmen. Auch in der Wissenschaft setzt man sich mit diesem Thema auseinander. So hat Andrew McAfee, ein Professor an der Harvard Business School, einen Artikel unter dem Titel Enterprise 2.0: The Dawn of Emergent Collaboration verfasst und damit ein weiteres Schlagwort geprägt: Enterprise 2.0 .McAfee definiert den Begriff wie folgt: Enterprise 2.0 is the use of emergent social software platforms within companies, or between companies and their partners or costumers . Die Konzepte die hinter Web 2.0 und Social Software stecken, können zur Verbesserung der Unternehmenskommunikation und der Zusammenarbeit beitragen. Das Konzept der Wikis möchte ich in dieser Arbeit aufgreifen. Bekannt geworden sind Wikis durch die freie Online-Enzyklopädie Wikipedia, welche 2001 durch Jimmy Wales ins Leben gerufen wurde. Wikipedia ist eine Enzyklopädie, bei der sich jederLeser auch als Autor betätigen kann und das nahezu ohne hierarchische Einschränkungen. Hinter Wikipedia steckt ein Wiki-System mit einem bestimmten Wiki-Prinzip, als Werkzeug zur kollaborativen Erfassung und Verteilung von Wissen. Das Potential des Einsatzes von Wikis in Unternehmen haben bereits zahlreiche Firmen erkannt, darunter auch Konzerne wie IBM und Microsoft. In dieser Arbeit möchte ich erörtern wie die Anwendungsmöglichkeiten für Wikis inUnternehmen aussehen und welche Aspekte bei der Verwendung von Wiki-Systemen speziell im Unternehmenskontext zu beachten sind. Die Schwerpunkte sind dabei: - Erläuterung des Wiki-Prinzips. - Einordnung in den Bereich Web 2.0. - Erläuterung der Grundfunktionalität eines Wiki-Systems. - Herausarbeiten der Unterschiede zwischen einem offenen Wiki und einem Unternehmenswiki. - Herausarbeiten typischer Anwendungsmöglichkeiten auf Basis der Literatur zum Thema Wiki. - Herausarbeiten der Aspekte die bei der Einführung eines Wikis in ein Unternehmen beachtet werden müssen. Cloud computing may be borderless, but taxes are territorial. It is easy to imagine how the two concepts can clash. Much effort has gone into harmonizing tax rules across borders with the result that many jurisdictions have very similar tax rules. Even so, taxation remains a basic expression of national sovereignty. The goal of this thesis is to examine how international tax law applies to the cross-border cloud computing business. Both, multinational providers and customers of cloud computing services are analyzed. Reflecting three traditional areas of international tax scholarship, the goal could be stated in three questions. Which jurisdictions have the right to tax? What kinds of cloud computing transactions can be taxed? What amount of the profit is taxable? In more technical terms, this means enquiring into how the use of cloud computing affects the permanent establishment status of taxpayers, how the different kinds of cloud computing transactions are characterized under international double taxation treaties, and how the calculation of taxable cloud computing profit is affected by transfer pricing. In light of the current political events, the thesis also offers recommendations de lege lata through a systematic approach. Its first part assesses the current taxation of cloud computing. The second part evaluates whether the findings of this initial assessment conform to various superior principles of good rulemaking. It identifies which of the present tax rules ought to be adapted. The final part considers how the rules could be amended to become more compliant with the superior principles. In this way, Part I embodies the thesis, Part II the antithesis, and Part III seeks a synthesis.
