In his book 21 Lessons for the 21st Century the historian Yuval Noah Harrari wrote that man had the possibility to conquer the world precisely because he could create fictional stories and believe in them. People created more and more complex stories about themselves that served and continue to serve, according to the professor of the University of Jerusalem, building unity, social harmony and gaining power. A narrative about past, in which memory fragmentation and victimisation play a large role, may be a temptation to instrumentalise the past. This is especially true in relation to the events of the twentieth century, when a series of bloody war conflicts occurred. As shown in the following post-conference volume, today the wars of the past (World War I and World War II, Indian-Pakistani war) and current conflicts (Russo-Ukrainian war, war in Sudan or Nagorno-Karabakh) are also a catalyst for the process of instrumentalisation. This process can be analysed both at the level of the evolution of the language of conflict, including the erosion of the values of democratic dialogue, and the use of specific means of commemorating the past (monuments, museums, the Internet).

Global competition now shapes economies and societies in ways unimaginable only a few years ago, and competition (or 'antitrust') law is a key component of the legal framework for global competition. These laws are intended to protect competition from distortion and restraint, and on the national level they reflect the relationships between markets, their participants, and those affected by them. The current legal framework for the global economy is provided, however, by national laws and institutions. This means that those few governments that have sufficient 'power' to apply their laws to conduct outside their own territory provide the norms of global competition. This has long meant that the US (and, more recently, the EU) structure global competition, but China and other countries are increasingly using their economic and political leverage to apply their own competition laws to global markets. The result is increasing uncertainty, costs, and conflicts that burden global economic development. This book examines competition law on the global level and reveals its often complex and little-understood dynamics. It focuses on the interactions between national and international legal regimes that are central to these dynamics and a key to understanding them. Part I examines the evolution of the current global system, the factors that have shaped it, how it operates today, and recent efforts to alter that system-e.g., by including competition law in the WTO. Part II focuses on national competition law systems, revealing how national laws and experiences shape global competition law dynamics and how global factors, in turn, shape national laws and experiences. It examines the central roles of US and European law and experience, and it also pays close attention to countries such as China that are playing increasingly important roles in the global competition law arena. Part III analyzes current strategies for improving the legal framework for global competition and identifies the factors that may contribute to a system that more effectively supports global economic and political development. This analysis also suggests a pathway for moving toward that goal.

The introduction of the single currency in the European economic space constitutes without doubt the most visible step towards monetary and economic integration in the EU. Those who boosted the birth of the Common Market in 1957 dreamt that this would one day come about as a logical consequence of the integration process. However, things have gone much more slowly than possibly imagined, although if taken in an adequate historic perspective, it is undeniable that the agreements that have led to European Monetary Union signify a really formidable jump in the process of political and economic integration in Europe. This is something many doubted would ever happen, but which is already a reality, although still in need of a period of consolidation. The most general economic consequences of the EMU have already been analysed in considerable depth. Proof of this is the literature already available. In general, there is coincidence in affirming that the balance of the results expected is clearly positive. Firstly, as a result of the anticipated gains in efficiency, a consequence of reduction of transaction costs associated to the previous existence of different currencies and of the elimination of exchange rate uncertainties.

Mit Blick auf die Prozesse der Globalisierung und der europäischen Integration werden die Potentiale im polnischen Städtesystem für die Ausbildung metropolitaner Funktionen eingeschätzt sowie die Möglichkeiten für die Herausbildung eines neuen europäischen Kernraumes unter Beteiligung polnischer Agglomerationen betrachtet. Im Ergebnis lässt sich festhalten,dass die polnische Hauptstadt Warschau eindeutig als europäische Metropole eingestuft werden kann. Eine Reihe weiterer bedeutender polnischer Städte ist zudem auf einem viel versprechenden Weg, ebenfalls an internationaler Bedeutung zu gewinnen und in den "Rankings" der europäischen Stadtregionen aufzusteigen. In Bezug auf die Ausbildung eines zweiten bzw. dritten europäischen Kernraumes (neben dem europäischen "Pentagon" und dem "europäischen Sunbelt") sind sehr viele potentielle Raumbilder denkbar. Letztlich scheint jedoch eine Verflechtung unter den bedeutendsten mitteleuropäischen Hauptstädten (Budapest, Bratislava, Wien, Prag, Berlin und Warschau) in Form einer so genannten "Triangel" wahrscheinlich.

Inhaltsangabe:Einleitung: Da die Umwelthaftung durch die EU-Umwelthaftungsrichtlinie aus dem Jahr 2004 -mit ihrem für Deutschland geltenden Umweltschadensgesetz vom 14.11.2007 -bedeutend erweitert wurde, wirkt sich dies auf die Unternehmen in Deutschland aus. Betroffene Unternehmen müssen sich anpassen, um nicht eventuell existenzbedrohender Risiken aus der Umwelthaftung ausgesetzt zu sein. Daher ist deren Betrachtung vor dem Hintergrund dieser Veränderungen sinnvoll und wichtig. Im Folgenden soll die Haftung für Unternehmen im Bezug auf die alte und neue Rechtslage aufbereitet werden und so zum Verständnis der Risiken und voraussichtlichen Entwicklung beitragen. Das Umweltrecht in Deutschland blickt auf eine mittlerweile etwa 50-jährige Geschichte zurück und begann in den 60er Jahren des vergangenen Jahrhunderts mit dem Gewässerschutz. In den 70er Jahren rückte mit dem Immisionsschutzrecht der Schutz der Luft in den Vordergrund und in den 80er Jahren stand dann das zivile Umweltrecht im Mittelpunkt des Interesses. Ein wichtiges Ergebnis war das 1991 in Kraft getretene Umwelthaftungsgesetz (UHG). Die gesamten 90er Jahre waren geprägt vom Problem belasteter Industriestandorte, so dass zu dieser Zeit der Schutz des Bodens als wichtigster Aspekt die Umweltschutzbemühungen prägte. Dies mündete im Bundesbodenschutzgesetz (BBodSchG), das 1997 in Kraft trat. Durch die Entwicklungen des Umweltrechts ergab sich für die Versicherungswirtschaft ein neues Geschäftsfeld, welches durch Versicherungslösungen abgedeckt werden musste. Diesem erweiterten Bedarf für neue Versicherungsprodukte entsprangen unter anderem: die Gewässerschadenhaftpflichtversicherung in den 60er Jahren. die Umwelthaftpflichtversicherung in den 90er Jahren. die Bodenkaskoversicherung ebenfalls in den 90er Jahren. Die EU-Umwelthaftungsrichtlinie hingegen umfasst nicht mehr nur den privatrechtlichen Schutz von Böden, Gewässern oder Arten, sondern schließt eine öffentlich rechtliche Haftung mit ein. Das deutsche Umweltschadensgesetz (USchadG) setzt die rechtlichen Vorgaben der EU um und eröffnet mit seiner Einführung einen wichtigen neuen Aspekt des Umweltschutzes. Eine öffentlich rechtliche Haftung von Umweltschäden, also Schutzgüter betreffend, die keinen konkreten Eigentümer haben außer der Natur an sich, ist ein völlig neuer Aspekt, welcher viele Fragen aufwirft und großen Diskussionsbedarf geweckt hat. Mit "Differenzierte Integration in der Europäischen Wirtschafts- und Währungsunion" bezeichnet der Autor die derzeitige Situation, in der einige Mitgliedstaaten dem Euro-Währungsgebiet nicht angehören, weil sie entweder die einheitliche Währung nicht einführen können oder nicht wollen. Die Rechtsfragen, die sich hieraus ergeben, sind auch sieben Jahre nach der Einführung des Euro und mehr als zwölf Jahre nach In-Kraft-Treten des Vertrages von Maastricht, der die Vorschriften zur Wirtschafts- und Währungsunion in den EG-Vertrag einfügte, in der juristischen Literatur nur selten erörtert worden. Der Autor unternimmt es, diese Lücke zu schließen. Die Arbeit ist vor allem für all diejenigen von Bedeutung, die sich in Wissenschaft und Praxis mit dem Geld-, dem Währungs-, dem Zentralbank- oder dem Europarecht beschäftigen. Grundlegende juristische Hintergrundinformationen bietet sie aber auch den Wirtschaftswissenschaften, insbesondere für Untersuchungen zur Geld- und Währungspolitik. Als Beitrag zum Konzept der differenzierten Integration und dessen praktische Anwendung ist sie schließlich für die Politikwissenschaften von Interesse. Die Arbeit gliedert sich in vier Teile. Die erste enthält eine Einleitung, in der u.a. das Konzept der differenzierten Integration und die Hintergründe für die Verwirklichung der Wirtschafts- und Währungsunion im Wege differenzierter Integration dargestellt werden. Im zweiten und umfangreichsten Teil der Arbeit untersucht der Autor die Rechtsfragen, die sich ergeben, wenn für mindestens einen Mitgliedstaat eine so genannte Ausnahmeregelung gilt, weil dieser Staat bislang die Voraussetzungen für die Einführung des Euro nicht erfüllen konnte. Er geht hier auf alle Bereiche der Wirtschafts- und Währungspolitik ein, also neben der Wirtschafts- und Währungspolitik auch auf die institutionellen Fragen, die sich stellen, und die Voraussetzungen, unter denen ein Mitgliedstaat, für den eine Ausnahmeregelung gilt, den Euro einführen kann. Der dritte Teil befasst sich mit den Sonderregeln, die für Dänemark und Großbritannien in der Wirtschafts- und Währungsunion gelten. Die Arbeit schließt in ihrem vierten Teil schließlich insbesondere mit einem Ausblick auf den Europäischen Verfassungsvertrag und die Auswirkungen, die sich aus ihm für die Wirtschafts- und Währungsunion hinsichtlich der in der Arbeit untersuchten Fragestellung ergeben.
