Permohonan dan pemberian sertipikat hak atas tanah adalah perbuatan administratif yang menurut UU No. 30/2014 harus dilakukan sesuai peraturan-perundang-undangan. Jika bertitik tolak dari ketentuan undang-undang tersebut, maka semua pegawai dan pejabat ATR/BPN termasuk didalamnya pemohon sertipikat hak atas tanah jika melakukannya sesuai peraturan perundang-undangan maka tidak akan ada pihak yang ditangkap, disidik, dituntut dan dipidana. Namun sebaliknya, orang yang melakukan proses pensertipikatan hak atas tanah walaupun sudah dilaksanakan sesuai peraturan perundang-undangan, namun diketahui kemudian ada perbuatan yang dilarang oleh hukum pidana, maka perbuatan tersebut seketika menjadi ranah hukum pidana dan bukan soal administrasi lagi. Walaupun UU No. 30/2014 sudah memberikan panduan jelas soal tata kelola administrasi sejak tahun 2014, namun di tahun 2020-2022 muncul kejahatan mafia tanah pada pensertipikatan tanah sampai munculnya peristiwa penangkapan (oknum) pejabat ATR/BPN, termasuk pejabat pemerintahan lain dan pelaku usaha di Jakarta dan beberapa daerah di Indonesia. Fenomena dan masalah mafia tanah di masa itu, mengundang perhatian Kepala Negara, Jaksa Agung, Kapolri, Ketua KPK, Komisi II dan Komisi III DPR-RI dan muncul pernyataan keras dari Presiden Joko Widodo; “jika ada mafia tanah agar di gebuk” artinya dipukul sampai pingsan/mati. Selain daripada itu, di tahun itu, ada fenomena lain yang ambivalen antara jargon ATR/BPN dengan fakta di lapangan. Jargon yang membanggakan sebagai wilayah bebas korupsi (WBK) dengan aparatur yang beraklak, profesional dan pelayanan pertanahan berkelas dunia berbeda dengan realitas di lapangan, tepat di bulan Oktober 2022—pejabatnya—eks Kepala Kantor Pertanahan Lebak-Banten dan calo tanah ditangkap Kejaksaan Tinggi Banten akibat peragaan mafia tanah. Realitas sebelumnya, Kepala Kantor Pertanahan Palembang yang dikenal di kantornya sebagai orang baik Juli 2022 ditangkap Polda Metro Jaya karena mafia tanah. Kemudian awal Desember 2022, Kepala Kantor Wilayah BPN Riau ditangkap dan ditahan KPK akibat suap perpanjangan Hak Guna Usaha. Gap antara idealisme dengan realisme dalam pengelolaan pertanahan menjadi fakta hukum, yang selama ini, sangat jarang terjadi ada pejabat ATR/BPN terlibat mafia tanah (dapat) ditangkap aparat hukum. Fakta dan realitas mafia tanah dan gap idealisme versus realisme pengelolaan pertanahan adalah alasan ditulisnya buku ini, senyampang melakukan kajian apa dan bagaimana kejahatan mafia tanah jika dilihat dalam perspektif hukum, intelijen, kriminologi, dan psiko-analisis. Muncul kemudian menggagas penggunaan azas primum remedium guna mengatasi mafia tanah dan tidak lagi menggunakan ultimum remedium guna menangani kejahatan mafia. Buku ini, adalah kelanjutan dari buku series sebelumnya, yang berjudul Hukum Pidana Agraria (2017), Intelijen Pertanahan (2018), dan Pendapat Hukum: Bangunan Fungsi dan Penerapan & Contoh Pendapat Hakim Pada Tindak Pidana Agraria (2019) yang sengaja ditulis untuk sharing note sesama kolega, komunitas, dan aparat serta penegak hukum.

Dina Siegel and Hans Nelen The term ‘global organized crime’ has been in use in criminology since the mid 1990s. Even more general and abstract than its daughter-terms (transnational or cross-border organized crime), ‘global organized crime’ seems to embrace the activities of criminal groups and networks all around the planet, leaving no geographical space untouched. The term appears to cover the geographical as well as the historical domain: ‘global’ has taken on the meaning of ‘forever and ever’. Global organized crime is also associatively linked with ‘globalisation’. The social construction of both terms in scientific discourse is in itself an interesting theme. But perhaps even more interesting, especially for academics trying to conduct empirical research in this area, is the analysis of the symbolic and practical meaning of these concepts. How should criminologists study globalisation in general and global organized crime in particular? Which instruments and ‘theoretical luggage’ do they have in order to conduct this kind of research? The aim of this book is not to formulate simple, straightforward answers to these questions, but rather to give an overview of contemporary criminological research combining international, national and local dimensions of specific organized crime pr- lems. The term global organized crime will hardly be used in this respect. In other social sciences, such as anthropology, there is a tendency to get rid of vague and abstract terms which can only serve to confuse our understanding. In our opinion, criminology should follow this initiative.

Nowadays organized crime is a very important political issue in Europe. However, scientific studies on the nature and seriousness of this problem are very scarce in the member states of the Council of Europe and the European Union. This national study on organized crime in the Netherlands was prepared for the Commission of Inquiry of the Dutch Parliament that recently made an investigation into the regulation and use of undercover policing. It not only contains an analysis of the contemporary manifestations of traditional organized crime, but also answers the question whether organized crime already has penetrated legitimate sectors of the economy or not. In addition special attention is paid to the role of the liberal professions and the banking system; and to the use of counter-strategies by criminal groups (corruption, intimidation, violence, disinformation, etc.)
