Once ratified, the Comprehensive and Economic Trade Agreement (CETA) could ultimately eliminate all tariff barriers between the European Union and Canada. CETA is also a new generation Free-Trade Agreement: it includes the opening of public procurement, the facilitation of cross investments and cooperation in the area of regulation. Its long negotiation process illustrated important changes that are happening in the way trade agreements are negotiated, both in Canada and in the EU. A wide variety of actors was involved. Because the federal government of Canada cannot implement international commitments in areas of provincial jurisdiction, the European Union requested that the provinces should be included in the discussions – Quebec and Ontario being the most interested. From the EU side, Germany, France and the United Kingdom led the process. Labor and trade unions as well as lobbying groups also supported the project. Following the signing of the agreement in October 2013, the ratification process was delayed because of the start of the TTIP negotiations between the European Union and the United States. Canadian civil society organizations had already expressed criticism, which was echoed by their European counterparts, particularly worried about the investor state dispute settlement (ISDS) system. The legal scrubbing phase resulted in a compromise on this point. The new Prime Minister Justin Trudeau, who replaced Conservative leader Stephen Harper in October 2015, has considered the implementation of the agreement as Canada's top priority regarding international trade.

The Canada–European Union Comprehensive Economic and Trade Agreement (CETA) is hailed as the gold standard for trade agreements. It addresses tariffs on traded goods, favoured status for EU and Canadian exporters, trade in services, and technical barriers to trade, while also seeking coordination between government agencies to promote regulatory cooperation, harmonization, and mutual recognition of standards. As the world retreats towards populism and protectionism, CETA Implementation and Implications provides a vital examination of this contemporary economic collaboration between developed states, which serves as a model for other progressive regional trade agreements. This book offers the first in-depth, comprehensive assessment of CETA, covering many of its most important elements and exploring its obstacles, accomplishments, and early effects. Based on the European Commission-funded Erasmus+ Jean Monnet Project on CETA Implementation and Implications, which linked scholars and stakeholders across Europe and North America to analyze and evaluate the implementation and impacts of the agreement, this book covers regulation, procurement, the environment, the innovative investment disputes system, labour mobility and labour relations, bilateral governance instruments, and the implications for EU trade policy of CETA’s contested ratification. Uniquely interdisciplinary and featuring contributors from around the world, CETA Implementation and Implications provides a nuanced and balanced assessment of this landmark trade agreement and its effects on regional and global trade in turbulent times.

This book provides a comprehensive account of the CETA Investment Chapter’s ability to overcome the legitimacy crisis facing investment arbitration. To do so, it first examines the root causes behind the legitimacy crisis, ultimately arguing that it reflects a fundamental rule of law crisis within investment arbitration. In particular, it asserts that the normative standpoints of the legitimacy crisis form part of the rule of law, the uniting legal principle from which the legitimacy concerns stem. The book contends that the rule of law is not only the principal normative and causal assumption on which the legitimacy concerns are based, but that it could also be utilized as a platform to evaluate the investment arbitration mechanism in CETA's Investment Chapter. Based on this, the book evaluates CETA's Investment Chapter through the rule of law framework in order to provide a convincing account of the latter's ability to overcome the legitimacy crisis facing investment arbitration. It concludes that CETA's Investment Chapter is unlikely to completely solve the legitimacy crisis simply because it is just a patchwork of reforms rather than a comprehensive reinvention of the substantive and procedural law of investment arbitration. Lastly, the book offers meaningful insights into the way the challenges presented by investment arbitration should be addressed. The book is intended for academics researching international investment law and arbitration as well as for policy-makers focusing on reforming investor-state dispute settlement.

The Great Recession and the turn towards all forms of protectionism stress the relevance of international trade policy. With the global economy undergoing deep structural changes, the negotiations between Canada and the EU on a Comprehensive Economic and Trade Agreement (CETA) present a real-time experiment that sheds light on the direction that the relationships between two economic units of the G8 will take. For Canada, an agreement with the EU would end its current dependency on the US; for the EU, an agreement with Canada would be a first with a G8-economy and indicate how its new trade strategy ‘Global Europe’ will look like. This book is the first to simultaneously analyze the undercurrents of this project and introduce the main topics at hand. CETA is much more than a simple free trade agreement, its breadth covers regulatory aspects in goods, services, and finance; the opening of public procurement markets; attitudes and policies of Canadian provinces towards liberalization; climate policies and international leadership claims of the EU in comparison to Canadian policy attempts; the challenges of the Euro project and the reform efforts; and the challenges of the Euro as a international reserve currency. CETA is a challenging project that will kick-start enormous changes in trade policy-making as well as in market openness in Canada. It will mark the EU’s efforts to re-make the Atlantic Economy. This book provides deep insights into the ambiguity of the project and addresses the implications of a rapidly changing global economy for trade policy. Offering analysis of the financial industry, banking, trade policy, climate change strategy, and the Euro exchange rate, this book should be of interest to students and policy-makers alike.

Studienarbeit aus dem Jahr 2019 im Fachbereich VWL - Internationale Wirtschaftsbeziehungen, Note: 2,0, FOM Hochschule für Oekonomie & Management gemeinnützige GmbH, München früher Fachhochschule, Sprache: Deutsch, Abstract: The decision on the Brexit has triggered an unprecedented process in European integration: differentiated disintegration, the selective reduction of the level and scope of integration of a member state. The extent to which European integration is influenced by this phenomenon is discussed in more detail in this paper. Also, the effect of a free trade agreement similar to the CETA, as a solution for Brexit and to counter political separatism. In addition to free trade and the abolition of customs duties, this solution also has negative consequences, provided that no concessions are made to the UK, especially in the area of services. These would have to be taken in order to respect the different economic structure of the UK compared to Canada. The traditional CETA would therefore have to be modified for the UK, which makes a CETA+ quite conceivable. Whether and to what extent Brussels will make concessions to the UK will have to be observed in the future. Already in January 2013 the British Prime Minister David Cameron has promised to renegotiate the European integration of the United Kingdom in a referendum. On 23 June 2016 it was followed by what many, not even the Brexit supporters, had seriously reckoned: In a referendum, 51.9% of the members voted in favour of leaving the EU. This triggered an unprecedented process in the history of European integration - differentiated disintegration. The day after the election, Europe was in turmoil, as can be seen from the following statements: Donald Tusk, President of the European Council, spoke of a "historic moment, but certainly not the time for hysterical reactions". Federal Chancellor Angela Merkel explained the result not only as a "cut for Europe", but also as a "cut for the European unification p
