A trend found in many Islamic societies in recent years has been the increasing regulation of family life by Islamic law and a corresponding move away from customary law and informal conflict resolution procedures. The situation in Malaysia, particularly in urban Malay society, is no exception here. Several studies already exist of the nature and extent of Malaysia's Islamic judicial system but the general tendency has been to ignore the actual operation of the syariah courts and related institutions. This study addresses this need with an in-depth analysis of the key area of intra-family conflict and demonstrates that, although formally the counsellor, kadi and judge have defined roles for conflict resolution, in practice much flexibility is evident in the use of consultation, conciliation, mediation, arbitration and adjudication techniques. This study will be of special interest to legal anthropologists and those scholars interested in the increasing application of Islamic law in many different countries.

Mediation In The Asia Pacific Region written by Dale Bagshaw and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2009-09-10 with Political Science categories.

This book examines mediation in connection with peacebuilding in the Asia-Pacific region, providing practical examples which either highlight the weaknesses within certain mediation approaches or demonstrate best-practice. The authors explore the extent to which current ideas and practices of mediation in the Asia-Pacific region are dominated by Western understandings and critically challenge the appropriateness of such thinking. Featuring a range of case studies on Fiji, Vanuatu, Papua New Guinea, Malaysia, Vietnam, China, Singapore, Indonesia, the Philippines and Thailand, this book has three main aims: To challenge dominant Western practices and ways of thinking on mediation that currently are being imposed in the Asia-Pacific region; To develop culturally-fluent and socially just mediation alternatives that build upon local, traditional or religious approaches; To situate mediation within ideas and practices on peacebuilding. Making a unique contribution to peace and conflict studies literature by explicitly linking mediation and peacebuilding practices, this book is a vital text for students and scholars in these fields.

Malaysia is one of the most intriguing countries in Asia in many respects. It consists of several distinct areas, not only geographically but ethnically as well; along with Malays and related groups, the country has a very large Indian and Chinese population. The spoken languages obviously vary at home, although Bahasa Malaysia is the official language and nearly everyone speaks English. There is also a mixture of religions, with Islam predominating among the Malays and others, Hinduism and Sikhism among the Indians, mainly Daoism and Confucianism among the Chinese, but also some Christians as well as older indigenous beliefs in certain places. This second edition of Historical Dictionary of Malaysia contains a chronology, an introduction, appendixes, and an extensive bibliography. The dictionary section has over 500 cross-referenced entries on important personalities, politics, economy, foreign relations, religion, and culture. This book is an excellent resource for students, researchers, and anyone wanting to know more about Malaysia.

Changing Marriage Patterns In Southeast Asia written by Gavin W. Jones and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2015-08-04 with Family & Relationships categories.

Various forms of partnering – such as officially registered marriages, cohabiting relationships, and other kinds of relatively stable relationships - are crucial in the formation of families throughout the world. Although, today, forms of partnering in the region are not restricted to formal marriage, the norm remains for couples to marry – to establish a new family, and to accept the cultural requirement to have children. This book provides a comprehensive and up-to-date picture of partnerships and marriage in the Southeast Asian region using quantitative data alongside qualitative approaches.Through the research of demographers, sociologists and anthropologists, it examines the way trends in the formation and dissolution of marriages are related to changes in the region’s economy and society; illuminating both the broad forces affecting marriage patterns and the way these forces work out at the individual and family level. Presenting the variety of contemporary marriage patterns in the region, with an emphasis on the ways in which marriage issues impinge on the welfare of those concerned, this book will be essential reading for students and scholars of Southeast Asia and the sociology of the family.

Shari A Law And Modern Muslim Ethics written by Robert W. Hefner and has been published by Indiana University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2016-08-29 with Law categories.

Many Muslim societies are in the throes of tumultuous political transitions, and common to all has been heightened debate over the place of sharia law in modern politics and ethical life. Bringing together leading scholars of Islamic politics, ethics, and law, this book examines the varied meanings and uses of Islamic law, so as to assess the prospects for democratic, plural, and gender-equitable Islamic ethics today. These essays show that, contrary to the claims of some radicals, Muslim understandings of Islamic law and ethics have always been varied and emerge, not from unchanging texts but from real and active engagement with Islamic traditions and everyday life. The ethical debates that rage in contemporary Muslim societies reveal much about the prospects for democratic societies and a pluralist Islamic ethics in the future. They also suggest that despite the tragic violence wrought in recent years by Boko Haram and the Islamic State in Iraq, we may yet see an age of ethical renewal across the Muslim world.

“This book should find its place in every person's library...[it is] a resource for engagement and vital critical discourse.” Philip T. N. Koh, Star2 This is a much-welcome new edition of the seminal introduction to Malaysia's constitution by the leading expert in the field. Retaining its comprehensive approach, it examines constitutional governance in light of authoritarianism and continuing inter-communal strife, as well as examining the impact of colonisation on Malaysia's legal public law structure. Updated throughout to include all statutory and case law developments, it also retains its socio-political perspective. A must read for all students and scholars of Malaysian law.
