Lei no 11.340/06 (Lei Maria da Penha). Apresenta vedação ligada à substituição da pena privativa de liberdade por restritiva de direitos de caráter unicamente financeiros; Lei no 11.343/06 (Lei de Drogas). Apresenta questões pertinentes à aplicação das penas, além da substituição da sentença exemplificadora desse tema; Lei no 11.464, de 28 de março de 2007. Alterou o § lo do art. 2o da Lei no 8.072/90 (Lei de Crimes Hediondos), permitindo que o regime fechado, no caso de crimes hediondos, seja aplicado apenas inicialmente e não integralmente; Leis no 11.689 e no 11.690, ambas de 09 de junho de 2008. Alteraram o Código de Processo Penal. A primeira promoveu modificações na sistemática do processo no tribunal do júri e, também, na sentença emanada deste órgão, estabelecendo, por exemplo, as circunstâncias judiciais (atenuantes e agravantes) como de competência do juiz-presidente. A segunda, no que diz respeito principalmente às provas processuais e perícias, alterou a redação do art. 386 do CPP, que cuida da sentença absolutória; Lei no 11.705, de 19 de junho de 2008. Deu nova redação ao art. 296 do Código de Trânsito Brasileiro, afastando a existência de discricionariedade do magistrado quanto à aplicação da pena de suspensão da permissão ou habilitação para dirigir veículo automotor, nos casos em que o agente for reincidente em crime de trânsito; Lei no 11. 719, de 20 de junho de 2008. Entre outras modificações, alterou normas do Código de Processo Penal referentes à emendatio e à mutatio libelli (arts. 383 e 384), às consequências da sentença condenatória (art. 387) e à abolição da prisão decorrente de sentença condenatória (art. 594).
