"El Derecho inglés es la imagen fiel del espíritu que lo ha creado. Gracias a su situación insular, Inglaterra ha sufrido menos que otros países la influencia de los derechos extranjeros. No estando sujeto por un derecho escrito, el Juez ha podido crear uno de acuerdo con la idiosincrasia de su país, guiándose por su inspiración personal y respetando la jurisprudencia anterior. Idea profundamente arraigada en el carácter inglés la de creer que la jurisprudencia, basada únicamente en los precedentes, es el mejor y más sano método de creación jurídica, el inglés, se ufana de no poseer en el día una codificación general. Se halla enamorado hasta tal punto de esta libre evolución jurídica, que no entorpece el mecanismo legislativo, que asimila toda codificación moderna a un lecho de Procusto, a un potro de tortura, al cual adapta el Juez de viva fuerza todo problema jurídico, impidiendo así la evolución del Derecho. El Juez, personaje estimado, es el guardián del derecho no escrito, transmitido a través de las edades por la tradición popular; generalmente se pronuncia solo, pero a veces está asistido de un Jurado que le ilustra sobre el sentimiento jurídico de sus conciudadanos. Su alta posición social, sus ingresos considerables, su nombramiento por la Corona y, sobre todo, un sentido común muy extenso, hacen de él el depositario del Derecho, universalmente reconocido como capaz e imparcial. Esta magistratura elegida es la que ha permitido llenar durante tanto tiempo la ausencia de leyes y de codificaciones, aunque, por lo demás, su labor se hallaba facilitada por el avanzado desarrollo social del pueblo".
