Il volume raccoglie una serie di scritti frutto di una riflessione comune agli autori sul ruolo del consumatore, oggi considerato dal legislatore europeo e italiano come esigente, responsabile e attivo, e non più solo debole e vulnerabile. L’obiettivo della ricerca è comprendere se questa figura del ‘consumatore evoluto’ sia reale o sia piuttosto una costruzione giuridica elaborata dai legislatori che, talvolta, privilegiano i desideri rispetto alla realtà. Sembra quasi in- fatti che sia l’ottimismo della volontà a spingere il legislatore a ipotizzare che il consumatore, ormai ‘evoluto’, opti per soluzioni in linea con le transizioni digitale e ambientale, spingendo il mercato verso risultati eticamente compatibili con i principi di welfare dell’Europa continentale. L’esito dell’indagine è tutt’altro che univoco e omogeneo nei diversi settori analizzati. Il volume guarda al consumatore se non nell’unità (perduta) della nozione data dal codice del consumo, almeno in un percorso evolutivo unico, attenuando nell’analisi sia l’effetto centrifugo delle regole di settore, sia la disarticolazione resa possibile dalla tecnologia e valutando, alla luce di ciò, se possa effettivamente riconoscersi la figura del consumatore ‘evoluto’ e con quali conseguenze sul piano delle tutele.
