La legge 3/2012 sulla crisi da sovraindebitamento colma un vuoto normativo, disciplinando il fenomeno dell'insolvenza del debitore "civile" su raccomandazione della Banca Mondiale. La disciplina si articola in distinte procedure concorsuali concordatarie fondate sull'accordo tra debitore e creditori e omologate dal tribunale, ovvero su una proposta del consumatore sovraindebitato, omologata dal tribunale all'esito di un giudizio di meritevolezza e fattibilità. Alternativa a tali soluzioni è la liquidazione dei beni, che si apre di regola a domanda del debitore, ed è modellata sulla disciplina della liquidazione fallimentare. Il ricorso alle procedure per sovraindebitamento è condizione per l'esdebitazione del debitore o consumatore dai debiti contratti sino all'apertura della procedura.

"By most accounts, the United States has deported around five million people since 1882-but this includes only what the federal government calls "formal deportations." "Voluntary departures," where undocumented immigrants who have been detained agree to leave within a specified time period, and "self-deportations," where undocumented immigrants leave because legal structures in the United States have made their lives too difficult and frightening, together constitute 90% of the undocumented immigrants who have been expelled by the federal government. This brings the number of deportees to fifty-six million. These forms of deportation rely on threats and coercion created at the federal, state, and local levels, using large-scale publicity campaigns, the fear of immigration raids, and detentions to cost-effectively push people out of the country. Here, Adam Goodman traces a comprehensive history of American deportation policies from 1882 to the present and near future. He shows that ome of the country's largest deportation operations expelled hundreds of thousands of people almost exclusively through the use of voluntary departures and through carefully-planned fear campaigns that terrified undocumented immigrants through newspaper, radio, and television publicity. These deportation efforts have disproportionately targeted Mexican immigrants, who make up half of non-citizens but 90% of deportees. Goodman examines the political economy of these deportation operations, arguing that they run on private transportation companies, corrupt public-private relations, and the creation of fear-based internal borders for long-term undocumented residents. This book examines the factors that facilitate the inclusion of women on high courts, while recognizing that many courts have a long way to go before reaching gender parity. Why did women start appearing on high courts when they did? Where have women made the most significant strides?To address these questions, the authors built the first cross-national and longitudinal dataset on the appointment of women and men to high courts. In addition, they provide five in-depth country case studies us to unpack the selection of justices to high courts in Canada, Colombia, Ireland, SouthAfrica, and the United States. The cross-national lens and combination of quantitative analyses and detailed country studies examines multiple influences across region and time. Focusing on three sets of explanations - pipelines to high courts, domestic institutions, and international influences -analyses reveal that women are more likely to first appear on their country's high court when traditional ideas about who can and should be a judge erode. In some countries, international treaties, regional emulation, and women's international NGOs play a role in disseminating and linking globalnorms of gender equality in decision-making.
