Februar 2005 den ersten Entwurf der Mindestanforderungen an das Risikomanagement (MaRisk) veröffentlichte. Fortan wurde und wird noch über die Regelungsinhalte, Herausforderungen und Auswirkungen der MaRisk auf die deutsche Kreditwirtschaft diskutiert. Die MaRisk verfolgen einen neuen ganzheitlichen Risikosteuerungs- und -überwachungsansatz, wobei die BaFin als Ziel eine qualitativ ausgerichtete Bankenaufsicht vor Augen hat. Besonders hervorzuheben sind die zahlreichen Wahlrechte und die flexiblen Umsetzungsmöglichkeiten, die insbesondere für kleine Kreditinstitute von Vorteil sind und die neuen Anforderungen für die Branche so interessant machen. Mit dem Rundschreiben 18/2005 veröffentlichte die BaFin am 20. Dezember 2005 die Endfassung der MaRisk. Dieses Referat soll einen Überblick über den Aufbau, die Inhalte und teilweise die Auswirkungen der MaRisk liefern. Im Folgenden wird der Hintergrund zur Einführung der MaRisk (Teil 2) und der Aufbau (Teil 3.1 und 3.2) skizziert, bevor im Teil 3.3 die übernommenen Mindestanforderungen behandelt werden. Die von der Aufsicht neu aufgenommenen Risiken sind Thema in Punkt 4 der Arbeit. Abschließend sollen die Auswirkungen in Teil 5 umrissen werden.
