Materials de Dret Constitucional. Principis constitucionals bàsics i òrgans constitucionals és el primer volum d’una sèrie de publicacions que serveixen per preparar el programa de Dret Constitucional com a assignatura que s’imparteix a diverses llicenciatures i diplomatures i que és present en els temaris d’oposicions de les administracions públiques. Cadascun dels dotze temes en què es divideix aquest primer volum s’estructura en set apartats. Els quatre primers ofereixen els fonaments teòrics de la lliçó corresponent: l’«Esquema» assenyala quina és l’estructura bàsica i quins són els aspectes més importants que cal conèixer. Les «Eines jurídiques» aporten informació sobre les fonts bibliogràfiques de cada tema i, si escau, sobre la normativa, la jurisprudència i els recursos electrònics de suport. S’indiquen, en tercer lloc, els «Objectius didàctics», i en les «Paraules clau» es defineixen els conceptes teòrics bàsics. Els tres darrers apartats proposen al lector una participació activa en la preparació del temari: els «Temes de debat» pretenen conduir a una reflexió més enllà dels objectius didàctics propis del tema, les «Preguntes d’elecció múltiple» constitueixen una eina per a l’autoavaluació, i els «Materials complementaris» són lectures de consolidació i ampliació dels coneixements adquirits. Mercè Barceló i Serramalera (Barcelona, 1962) és catedràtica de Dret Constitucional a la UAB. És autora, entre altres obres, de Derechos y deberes constitucionales en el estado autonómico (1991), Dret públic de Catalunya (2001; 2003) i La Ley orgánica. Ámbito material y posición en el sistema de fuentes (2004). Ha estat lletrada del Tribunal Constitucional i, actualment, és membre de la Comissió Jurídica Assessora de la Generalitat de Catalunya. Josep M. Castellà Andreu (Tortosa, 1967) és professor titular de Dret Constitucional a la UB. És autor, entre d’altres, de Los derechos constitucionales de participación política en la Administración pública (2001) i La función constitucional del Estatuto de autonomía de Cataluña (2004). Fernando Domínguez García (Barcelona, 1978) és professor lector de Dret Constitucional a la UAB. Doctor en Ciències Jurídiques per l’Institut Universitari Europeu de Florència l’any 2004, ha publicat la seva tesi amb el títol Las regiones con competencias legislativas (2005). Enriqueta Expósito Gómez (Barcelona, 1968) és professora titular de Dret Constitucional a la UB, universitat on es va doctorar l’any 2001. És autora, entre d’altres, de la monografia La libertad de cátedra (1995). Esther Martín Núñez (Barcelona, 1966) és professora titular de Dret Constitucional a la UB i autora, entre d’altres, del llibre El régimen constitucional del cargo público representativo. Territorial autonomy in Spain has reached a crossroads. After over thirty years of development, the consensus regarding its appropriateness has started to crumble. The transformation project embodied by the reform of Statute of Catalonia (2006) has failed to achieve its most significant demands. Although the concept of Spain as a Federation is disputed -more within the country than beyond-, the evolution of the Spanish system needs to follow a markedly federalist path. In this perspective, reference models assume critical importance. This edition gathers the works of a broad group of European, American and Spanish experts who analyse the present-day challenges of their respective systems. The objective, thus, is to contribute ideas which might help to address the evolution of the Spanish system in the light of the experience of more established Federations. This second volume focuses its attention on the difficulties and challenges faced in two particular fields. This book examines the development of the theory and practice of constitutionalism, defined as a political system in which the coercive power of the state is controlled through a pluralistic distribution of political power. It explores the main venues of constitutional practice in ancient Athens, Republican Rome, Renaissance Venice, the Dutch Republic, seventeenth-century England, and eighteenth-century America. From its beginning in Polybius' interpretation of the classical concept of mixed government, the author traces the theory of constitutionalism through its late medieval appearance in the Conciliar Movement of church reform and in the Huguenot defense of minority rights. After noting its suppression with the emergence of the nation-state and the Bodinian doctrine of sovereignty, the author describes how constitutionalism was revived in the English conflict between king and Parliament in the early Stuart era, and how it has developed since then into the modern concept of constitutional democracy.
