Dal secondo dopoguerra ad oggi il dibattito sul legame tra memoria e giustizia è stato un territorio interdisciplinare su cui si sono confrontati giuristi, storici, filosofi e sociologi. Nel ventesimo secolo sono state almeno quattro le grandi fasi di democratizzazione che hanno portato ad una messa in circolo nella sfera pubblica di temi quali la ricerca della verità, il recupero della memoria e la applicazione della giustizia in contesti post-bellici o post autoritari. Una prima fase è coincisa con la fine della seconda guerra mondiale; la seconda a metà degli anni settanta soprattutto nei paesi del sud dell’Europa; la terza agli inizi degli anni ottanta in America Latina; l’ultima a partire dai primi anni novanta in Africa. Nelle transizioni europee, ma anche nelle più recenti transizioni latinoamericane e africane, le metodologie giudiziarie ed i processi di costruzione mnemonica collettiva del passato hanno dato luogo a dinamiche costituenti complesse in cui si sono cristallizzati nuovi elementi sociali, politici e giuridici che hanno riconfigurato le identità nazionali. La ricostruzione fattuale e l’interpretazione condivisa del passato, infatti, restano uno snodo cruciale per la stabilità di ogni ordine giuridico, politico e sociale.

Un caso del quale la cronaca si è poco occupata, anche per il basso livello socio-economico e culturale di vittima e assassino. A renderne ancor più ricca la narrazione, il fatto che di esso (e della giovane vittima) ne abbiano parlato alcuni dei testimoni privilegiati intervistati durante la ricerca.

Results of the 2007 Nuremberg Conference on Peace and Justice: Tensions between peace and justice have long been debated by scholars, practitioners and agencies including the United Nations, and both theory and policy must be refined for very practical application in situations emerging from violent conflict or political repression.
