Drawing on a range of expert contributions, this book explores how the European Green Deal is being deployed in practice and observes how the EU tries to promote the protection of the environment in third countries. This book begins by assessing the state of the art in terms of the key conceptual issues and analyses sectoral initiatives that are particularly relevant for the deployment of the European Green Deal external dimensions. La obra Derecho contractual y mercado interior europeo se estructura en tres ejes temáticos en los que el análisis económico del Derecho juega un papel destacado. En el primero se analizan la supeditación de las competencias de la Unión Europea en materia de armonización del Derecho contractual a la efectiva mejora del funcionamiento del mercado interior, los requisitos que las medidas armonizadoras adoptadas deben cumplir y los parámetros aplicables por el Tribunal de Justicia en el enjuiciamiento de la validez de tales medidas. El segundo eje gira en torno a la incidencia del Derecho contractual en el funcionamiento del mercado interior, dados los mayores costes de transacción que la disparidad normativa implica en la contratación transfronteriza y las limitaciones inherentes al esquema sobre la ley aplicable a los contratos internacionales instaurado en el Reglamento Roma I, de acuerdo con los resultados de las evaluaciones de impacto y estudios realizados por las instituciones comunitarias. Los modelos de conformación del Derecho contractual europeo encaminados a paliar los problemas que la disparidad normativa supone para el funcionamiento del mercado interior articulan el tercer eje temático, en el que se abordan los pros y contras suscitados por los sistemas de armonización mínima/máxima basados en Directivas, se exploran los problemas derivados de la unificación a través de instrumentos opcionales restringidos a la contratación transfronteriza y se analizan críticamente las políticas regulatorias de la Unión Europea en materia contractual puestas en marcha a lo largo de estos últimos años.

Over the last two decades, EU legislation has established a growing number of subsidiary bodies commonly referred to as EU decentralised agencies. Recent years have witnessed the conferral of increasingly significant powers to these bodies to the point where the successful implementation of many of the EU's policies is now dependent upon the activities of EU agencies. While EU agencies have become indispensable in terms of their practical importance, the lack of a legal basis in the EU Treaties to establish and empower new bodies as well as the lack of an adequate framework in secondary law means that there exists little control over EU agencies. This results in critical issues, such as the absence of clear criteria prescribing when an agency may be empowered to act and also the failure to consider the interests of the actors normally responsible for the implementation of EU law, such as the Member States and the Commission. Providing the first comprehensive overview of the development of agencification in the EU, this book explores the question: What are the political and legal limits to EU agencification? Analysing EU agencies from an institutional and constitutional perspective, the book traces the development of EU agencies, explores the different tasks they perform, investigates the limits to agencification, and discusses the legal basis for such agencies.

Following a study on the world flows of American products during early globalization, here the authors examine the reverse process. By analyzing the imperial political economy, the introduction, adaptation and rejection of new food products in America, as well as of other European, Asian and African goods, American Globalization, 1492–1850, addresses the history of consumerism and material culture in the New World, while also considering the perspective of the history of ecological globalization. This book shows how these changes triggered the formation of mixed imagined communities as well as of local and regional markets that gradually became part of a global economy. But it also highlights how these forces produced a multifaceted landscape full of contrasts and recognizes the plurality of the actors involved in cultural transfers, in which trade, persuasion and violence were entwined. The result is a model of the rise of consumerism that is very different from the ones normally used to understand the European cases, as well as a more nuanced vision of the effects of ecological imperialism, which was, moreover, the base for the development of unsustainable capitalism still present today in Latin America.
