Microtrade is a mechanism to support development in the least developed states (“LDCs”) through the creation of a mechanism, structure, and organization that will facilitate small scale international trade from LDCs into more developed markets. Microtrade facilitates this through leveraging the lower labor costs in the LDCs, demand in more developed markets, and through collaborative and voluntary efforts to minimize the costs of shipping and other barriers to such small scale trading ventures. In so doing, there will be a whole host of conflicting legal cultures that may stand in the way of effective implementation of microtrade policies, though direct conflict or indirect conflict simply through attitudes and approaches that either undermine or do not support the different aspects of microtrade. The different legal cultures will belong to the varied participants within the LDCs, within the international organizations and fields that would be involved, and even within the developed states that will be the ultimate destination for microtrade products. While the difference between those legal culture issues will often serve as obstacles, sometimes they may preset opportunities that could enhance microtrade projects. Consequently, this chapter will identify many of the specific areas of potential conflict between the different legal cultures that are present throughout the different fora and communities involved in microtrade -- a legal culture impact analysis. Once identified it may then be possible to ameliorate any negative impact resulting from those conflicts. This chapter will, for the most part, focus on identifying the primary conflicts between the legal cultures that would be relevant to microtrade. Such identifications is the significant first step in eventually resolving any conflicts in order to ensure microtrade may work to best effect. This chapter will also provide a few examples of the mechanisms that could be employed to counteract or resolve those conflicts.

As a new international economic policy, microtrade will face a whole host of issues, including potential legal cultural obstacles. Poverty remains a serious global issue, and nearly half of the world's populations are still living below the poverty line. International trade has been a vehicle for successful economic development for some developing economies in East Asia, including South Korea, Taiwan, Hong Kong, Singapore, and more recently, China. With the success of their trade-based economic development policies and the export-driven development strategy, all of these countries escaped from poverty. Can other developing countries duplicate this success and also bring their populations out of poverty? Some factors, including political stability, organized government support, educated workforce, availability of foreign markets, and financial resources such as foreign loans, have been considered essential for the success of this export-driven economic development strategy. These factors are not present in many developing countries, particularly least-developed countries (LDCs), thus making it difficult for them to pursue successful trade-based development policies to break the circle of poverty. The author suggests microtrade, defined as international trade of small quantities of locally-produced products (LPPs) produced on a small scale, as an alternative way to provide those living in LDCs with income sufficient to reduce or eliminate poverty. Microtrade, unlike the export-driven development policies undertaken at a national level, is not based on the development of large-scale export industries, which cannot be initiated by many LDCs. This article provides a discussion of the theoretical basis of microtrade and its regulatory framework from the perspective of international trade law.
