There is a highly significant and under-considered intersection and interaction between migration law and labour law. Labour lawyers have tended to regard migration law as generally speaking outside their purview, and migration lawyers have somewhat similarly tended to neglect labour law. The culmination of a collaborative project on 'Migrants at Work' funded by the John Fell Fund, the Society of Legal Scholars, and the Research Centre at St John's College, Oxford, this volume brings together distinguished legal and migration scholars to examine the impact of migration law on labour rights and how the regulation of migration increasingly impacts upon employment and labour relations. Examining and clarifying the interactions between migration, migration law, and labour law, contributors to the volume identify the many ways that migration law, as currently designed, divides the objectives of labour law, privileging concerns about the labour supply and demand over worker-protective concerns. In addition, migration law creates particular forms of status, which affect employment relations, thereby dividing the subjects of labour law. Chapters cover the labour laws of the UK, Australia, Ireland, Israel, Italy, Germany, Sweden, and the US. The willingness to migrate in search of employment is in itself insufficient to compel anyone to move. The dynamics of labour mobility are heavily influenced by the opportunities perceived and the imaginaries held by both employers and regulating authorities in relation to migrant labour. This volume offers a multidisciplinary approach to the study of the structures and imaginaries underlying various forms of mobility. Based on research conducted in different geographical contexts, including the European Union, Turkey, and South Africa, and tackling the experiences and aspirations of migrants from various parts of the globe, the chapters comprised in this volume analyse labour-related mobilities from two distinct yet intertwined vantage points: the role of structures and regimes of mobility on the one hand, and aspirations as well as migrant imaginaries on the other. The presence of migrant workers has become a central feature of labour markets in highly developed countries. The International Labour Organisation estimates that in 2013 there were 112 million resident migrant workers in the 58 highest-income countries, who made up 16% of the workforce. Non-resident workers have also increasingly become part of the labour available for employment in other states, often on a temporary basis. This work takes a thematic and comparative approach to examine the profound implications of contemporary labour migration for employment law regimes in highly developed countries. In so doing, it aims to promote greater recognition of labour migration-related questions, and of the interests of migrant workers, within employment law scholarship. The movement of people in Southeast Asia is an issue of increasing importance. Countries of the Association of Southeast Asian Nations (ASEAN) are now the origin of 8 percent of the world's migrants. These countries host only 4 percent of the world's migrants but intra-regional migration has turned Malaysia, Singapore, and Thailand into regional migration hubs that are home to 6.5 million ASEAN migrants. However, significant international and domestic labor mobility costs limit the ability of workers to change firms, sectors, and geographies in ASEAN. This report takes an innovative approach to estimate the costs for workers to migrate internationally. Singapore and Malaysia have the lowest international labor mobility costs in ASEAN while workers migrating to Myanmar and Vietnam have the highest costs. Singapore and Malaysia's more developed migration systems are a key reason for their lower labor mobility costs. How easily workers can move to take advantage of new opportunities is important in determining how they fare under the increased economic integration planned for ASEAN. To study this question, the report simulates how worker welfare is affected by enhanced trade integration under different scenarios of labor mobility costs. Region-wide, worker welfare would be 14 percent higher if barriers to mobility were reduced for skilled workers, and an additional 29 percent if barriers to mobility were lowered for all workers. Weaknesses in migration systems increase international labor mobility costs, but policy reforms can help. Destination countries should work toward systems that are responsive to economic needs and consistent with domestic policies. Sending countries should balance protections for migrant workers with the needs of economic development.
