Gli scritti raccolti in questo terzo Quaderno del CERM nascono dal desiderio di promuovere un’occasione di studio sulla cittadinanza, sollecitata dall’esigenza di mettere a confronto due diverse prospettive, quella sociologica e quella giuridica.I cultori delle due materie, da tempo, concentrano la propria attenzione sul tema utilizzando le “proprie” categorie. Ciò costituisce un indubbio fattore di arricchimento, evidenziando le potenzialità di un approccio interdisciplinare, ma, sul piano del metodo, implica anche un dialogo costante, che permetta di valorizzare il contributo di ciascun sapere scientifico ed eviti, anche sul piano terminologico, incomprensioni fuorvianti. Gli scritti di questo volume tentano di offrire un contributo a questo dialogo, nella consapevolezza che solo un adeguato supporto conoscitivo possa assicurare al decisore politico gli strumenti necessari per affrontare la sfida dell’integrazione dei migranti e promuovere il consolidamento di ordinamenti autenticamente multiculturali.

Pensare i fenomeni migratori, così come i problemi legati all’immigrazione e all’integrazione, è un lavoro intellettuale che si può fare in molti modi, tutti legittimi. Il più delle volte, nella dottrina nazionale e internazionale, tale sforzo di comprensione è stato compiuto in una prospettiva sociologica, o politica, o economica, o giuridica. Più raramente tale lavoro di comprensione del fenomeno migratorio è stato compiuto in una prospettiva filosofica, e ancor più raramente in una prospettiva di filosofia del diritto. Scopo del presente lavoro è pertanto quello di colmare (in minima parte) questa lacuna, e riflettere sui problemi legati alle migrazioni collocandoli in un orizzonte filosofico, e di filosofia della giustizia. Non tutte le questioni possibili sono evidentemente oggetto di analisi, e tuttavia si è cercato di dare una risposta, o almeno un contributo alla riflessione, su alcuni dei temi più spinosi e più spesso oggetto del dibattito pubblico. In particolare, nel testo sono affrontate le questioni relative al riconoscimento dell’identità culturale dei migranti, e al riconoscimento di norme e tradizioni culturali spesso stridenti con quelle occidentali; le questioni relative alla gestione dei flussi migratori e alla maggiore o minore chiusura dei confini; le questioni, infine, legate al tema della cittadinanza. E si è cercato di farlo chiedendosi sempre quali possano essere le scelte più giuste, e più rispettose della dignità della persona, nella convinzione il diritto non possa rinunciare a radicarsi in tali dimensioni.

La presente pubblicazione non analizza soltanto la predetta disciplina, ma volge un ulteriore sguardo al Testo Unico immigrazione (D.Lgs. n. 286/98 ), nel tempo oggetto di continue modificazioni, che hanno interessato l’intero corpus giuridico del diritto degli stranieri. In particolare è stata posta l’attenzione sul diritto all’unità familiare, sui minori stranieri, su nuove tipologie di permessi di soggiorno, sul diritto dei lavoratori extracomunitari, sui provvedimenti di espulsione e sulle misure di protezione internazionale. 'Community' is one of those words that feels good: it is good 'to have a community', 'to be in a community'. And 'community' feels good because of the meanings which the word conveys, all of them promising pleasures, and more often than not the kind of pleasures which we would like to experience but seem to miss. 'Community' conveys the image of a warm and comfortable place, like a fireplace at which we warm our hands on a frosty day. Out there, in the street, all sorts of dangers lie in ambush; in here, in the community, we can relax and feel safe. 'Community' stands for the kind of world which we long to inhabit but which is not, regrettably, available to us. Today 'community' is another name for paradise lost - but for a paradise which we still hope to find, as we feverishly search for the roads that may lead us there. But there is a price to be paid for the privilege of being in a community. Community promises security but seems to deprive us of freedom, of the right to be ourselves. Security and freedom are two equally precious and coveted values which could be balanced to some degree, but hardly ever fully reconciled. The tension between security and freedom, and between community and individuality, is unlikely ever to be resolved. We cannot escape the dilemma but we can take stock of the opportunities and the dangers, and at least try to avoid repeating past errors.
