The over-representation of minorities, particularly African Amer., in the nation¿s prisons has received much attention in recent years. However, the disproportionate representation of racial/ethnic groups is not limited to adult prisons and jails. It is also found among youth confined in secure juvenile facilities. Since many data systems fail to disaggregate ethnicity from race, Latino youth are often counted as ¿White.¿ As a result, data on the extent to which minority populations are over-represented in the juvenile justice system are generally underreported in the analysis of this issue. This report presents several sources of data and utilizes both original and previously published analysis. Tables and graphs.

The United States Senate's Subcommittee on Juvenile Justice heard testimony on minority overrepresentation in the juvenile justice system and the sentencing of minorities within that system. In particular, the Subcommittee heard testimony from eight witnesses who suggested short- and long-term approaches for helping to eliminate racial bias in the juvenile justice system, as well as the need for more family and community services. Before the witnesses testified, Senator J. R. Biden, Jr., addressed the subcommittee on the pressing nature of the issues. The following witnesses appeared in two panels: (1) T. Cavalier, an apprentice at Youth Development, Inc. (Albuquerque, New Mexico); (2) R. Chavez, the Assistant Executive Director of Youth Development, Inc. (Albuquerque, New Mexico); (3) I. Fulwood, Jr., Chief of Police in Washington (District of Columbia); (4) C. Hunter, a graduate of Kenosha County (Wisconsin) Community-Based Services Program; (5) D. Ramirez, a judge in Denver (Colorado); (6) L. LeFlore of the Institute of Juvenile Justice Administration and Delinquency Prevention (Hattiesburg, Mississippi); (7) C. Williams of the Center for the Study of Social Policy (Washington, District of Columbia); and (8) C. O'Donnell of the Center for Youth Research, University of Hawaii (Honolulu, Hawaii). The witnesses described their personal experiences either as minority individuals in the juvenile justice system or as workers within the system and made suggestions for change and correction. (JB)

Based on a comprehensive study of three counties in Texas, this work examines the idea of differential handling of minority youth offenders. Traditional wisdom indicates that minorities are over-represented in the juvenile justice system due to racism and discrimination within the system itself. The author refutes this logic by challenging current studies and examining the results of the Texas study. The findings suggest that minorities are represented in the juvenile justice system in greater numbers than their majority offender counterparts due to their greater involvement in criminal activity, not to any differential treatment they may receive at crucial decision points within the system. Allegations of racial bias against the juvenile justice system are often supported by the federal government, which suggests that minorities continue to be targeted more frequently for arrest, prosecution, conviction, and imprisonment merely because they are persons of color. Drawing on new research, the author addresses racial disparity in the juvenile justice system and contends that previous research suffers methodological and statistical analysis problems, resulting in the mischaracterization of the issue of racial bias. The present study argues that most minority juveniles receive different case outcomes because of the severity of their current offense, and both the length and severity of their prior delinquency careers. Tracy's research ultimately indicates that rather than being discriminatory, the juvenile system is, instead, reacting to a particular type of delinquent using legally permissible guidelines.
