Esta obra apresenta para o leitor uma análise profunda do modelo brasileiro de precedentes, com base no que há de melhor na doutrina brasileira e estrangeira, e, ainda, no entendimento jurisprudencial atual acerca das respectivas matérias. Sem deixar de traçar as linhas essenciais do modelo clássico de precedentes existente em países de common law, a autora propõe que a análise do sistema de precedentes brasileiro deve partir da realidade pátria, com arrimo na legislação que lhe dá amparo. Questões essenciais para que se entenda o sistema brasileiro são tratadas por meio de profunda problematização. Em oito perguntas, pretende a autora, ao respondê-las, estabelecer as premissas do ordenamento brasileiro. Discutem-se, assim, temas como (i) se o CPC/2015 representa o deslocamento do processo civil brasileiro para a tradição de common law; (ii) qual seria a distinção conceitual entre os institutos da “jurisprudência”, “súmula” e “precedente”; (iii) se a implementação da observância a precedentes no Brasil trata-se de uma efetiva novidade ou se se configuraria no ápice de uma evolução gradual; (iv) quais seriam as razões pelas quais se optou por adotar um modelo de precedentes; (v) se o juiz limita-se a aplicar o direito existente ou se sua atividade é apta a criar direito; (vi) se o precedente judicial cria norma; (vii) qual seria a natureza dos provimentos jurisdicionais constantes do artigo 927, do CPC/2015 e qual o seu grau de vinculatividade e (viii) se o sistema brasileiro seria ou não constitucional. Por fim, após desenvolver os dois papéis que a fundamentação apresenta no CPC/2015 (endoprocessual e extraprocessual), propõe a autora a análise dos riscos existentes no modelo brasileiro e os instrumentos fornecidos pelo CPC/2015 para otimizar cada elemento vinculante componente do sistema de precedentes. O intuito último desta obra é fornecer elementos para reforçar que estabilidade, uniformidade e coerência da jurisprudência devem caminhar juntas com a legitimidade do exercício do poder jurisdicional, intuito este que somente poderá ser alcançado com a fundamentação substancial das decisões judiciais, inclusive aquelas proferidas com base em precedentes e súmulas.
