Gegenstand dieser Abhandlung ist die Untersuchung, ob und inwieweit sich die überkommenen Grundsätze des allgemeinen Schadensrechts auf das Schadensversicherungsrecht übertragen lassen. In einigen grundlegenden wie auch aktuellen versicherungsrechtlichen Entscheidungen lassen sich Bezugnahmen auf das allgemeine Schadensrecht finden, die meist ohne erkennbares System erfolgen und ohne dass das grundlegende Verhältnis beider Rechtsgebiete geklärt wird. Dr. Vincent Schreier geht daher der Frage nach, welche Bedeutung die Regelungen und Prinzipien des Schadensrechts sowie die hierzu ergangene Rechtsprechung für das Leistungsversprechen des Schadensversicherers haben, wie es in den Allgemeinen Versicherungsbedingungen (AVB) zum Ausdruck kommt. Hierzu wird am Beispiel verschiedener schadensrechtlicher Grundsätze (z.B. Wirtschaftlichkeitsgebot, Vorteilsausgleichung, Bereicherungsverbot, Dispositionsfreiheit, Totalreparation sowie Adäquanz- und Normzwecklehre) untersucht, ob ein durchschnittlicher Versicherungsnehmer, auf dessen Verständnis es bei der Auslegung von Versicherungsbedingungen ankommt, von bestimmten Regeln des Schadensrechts Rückschlüsse auf den Inhalt und Umfang des Leistungsversprechens des Versicherers ziehen kann.
