A situação jurídica de contribuinte impõe o reconhecimento do dever fundamental de pagar tributos, mas também assegura uma série de direitos e garantias que promovem o equilíbrio da relação jurídica tributária. Não se admite que a relação tributária seja baseada apenas na força do império estatal e na posição de mera sujeição, outrora ostentada pelos súditos, mas, ao contrário, estando o contribuinte inserido no contexto tributário como sujeito de direitos, sendo-lhe assegurada, inclusive, proteção à dignidade, o poder tributário encontra-se limitado pelos direitos fundamentais dos contribuintes. Esses direitos constituem o conteúdo jurídico do Estatuto do Contribuinte que, no caso brasileiro, está desenhado em normas constitucionais, portanto com grau hierárquico destacado. O Estatuto do Contribuinte, por sua vez, garante um núcleo irredutível de direitos fundamentais dos contribuintes que não pode ser atingido pela atividade tributária do Estado. Esse núcleo irredutível corresponde exatamente ao mínimo necessário para que os contribuintes possam desfrutar de uma vida digna e condizente com os seus propósitos, sendo identificado no plano tributário como mínimo imune. Merecem especial ênfase, nesse aspecto, os princípios tributários da capacidade contributiva e da vedação de utilização do tributo com efeitos confiscatórios, uma vez que atuam como critérios jurídicos que protegem a garantia constitucional do mínimo imune. Por fim, deve-se observar que a garantia do mínimo imune foi reconhecida de modo amplo pelo ordenamento jurídico brasileiro, impondo limite a qualquer espécie tributária.
