International Rule Of Law And Professional Ethics written by United Nations. University and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2013-09-01 with categories.

This book investigates the concept international rule of law, which can be a problematic one as terms such as international democracy, international welfare or international freedom of speech are not commonly used. International rule of law is defined as a process of recognition worldwide that law, both domestic and international, must be supreme and must remain detached from both power and bias. The authors argue that international rule of law is a gradual ascendance of law above power internationally, which can be illustrated in two ways: by global acceptance of the principles of rule of law and by repeated rulings of international tribunals, reaffirming that the supremacy of law places it above political, economic or other considerations. The book also examines how professional ethics, in particular the ethical behaviour of various groups of international employees, such as judges and prosecutors in international tribunals, diplomats and legal advisors, international civil servants and commissioners, can contribute to the development of the international rule of law.

The war on terror is remaking conventional warfare. The protracted battle against a non-state organization, the demise of the confinement of hostilities to an identifiable battlefield, the extensive involvement of civilian combatants, and the development of new and more precise military technologies have all conspired to require a rethinking of the law and morality of war. Just war theory, as traditionally articulated, seems ill-suited to justify many of the practices of the war on terror. The raid against Osama Bin Laden's Pakistani compound was the highest profile example of this strategy, but the issues raised by this technique cast a far broader net: every week the U.S. military and CIA launch remotely piloted drones to track suspected terrorists in hopes of launching a missile strike against them. In addition to the public condemnation that these attacks have generated in some countries, the legal and moral basis for the use of this technique is problematic. Is the U.S. government correct that nations attacked by terrorists have the right to respond in self-defense by targeting specific terrorists for summary killing? Is there a limit to who can legitimately be placed on the list? There is also widespread disagreement about whether suspected terrorists should be considered combatants subject to the risk of lawful killing under the laws of war or civilians protected by international humanitarian law. Complicating the moral and legal calculus is the fact that innocent bystanders are often killed or injured in these attacks. This book addresses these issues. Featuring chapters by an unrivalled set of experts, it discusses all aspects of targeted killing, making it unmissable reading for anyone interested in the implications of this practice.

Of The Law Of Nature And Nations written by Samuel Freiherr von Pufendorf and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 1703 with International law categories.

"In 1662 Pufendorf was appointed to the first modern professorship in natural law (at the University of Heidelberg). In 1670 he became professor of natural law at the University of Lund in Sweden. First published in 1672, this is his principle work and a landmark in the history of natural and international law. Beginning with a consideration of fundamental legal ideas and their various divisions, Pufendorf proceeded to a discussion of the validity of customs, the doctrines of necessity and innate human reason. The work is significant in part because it developed principles introduced by Grotius and Hobbes. Unlike Hobbes, Pufendorf argued that peace, not war, was the state of nature, and he proposed that international law was not restricted to Christendom." -- Lawbook Exchange.

Cloth. $125.* Chitty [1776-1841], the distinguished English legal scholar, produced this edition of Vattel's classic study to bring it to the attention of a wider audience. "[I]t is of infinitely more extended utility, he observed, because it "contains a practical collection of ethics, principles, and rules of conduct to be observed and pursued, as well by private individuals as by states, and these of the utmost practical importance to the well-being, happiness, and ultimate and permanent advantage and benefit of all mankind." It should therefore be studied "by every gentleman of liberal education, and by youth, in whom the best moral principles should be inculcated. The work should be familiar in the Universities, and in every class above the inferior ranks of society. And, as regards lawyers, it contains the clearest rules of construing private contracts, and respecting Admiralty and Insurance law.": Preface v.

Kant And Law written by B.Sharon Byrd and has been published by Routledge this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-07-05 with History categories.

Immanuel Kant's legal philosophy and theory have played an enormous role in the development of law since the eighteenth century. Although this influence can be seen primarily in German law and in the law of nations which have traditionally been oriented toward German legal development, today Kant's philosophy has experienced a Renaissance in the Anglo-American legal world. This anthology collects what the editors believe to be the very best of articles on Kant's legal theory, with an emphasis on his Metaphysics of Morals of 1797. In particular the articles relate to: 1) the nature of law and justice, 2) private law, 3) public law, 4) criminal law, 5) international law, and 6) cosmopolitan law.
