In his book, Sándor Agócs explores the conflicts that accompanied the emergence of the Italian Catholic labor movement. He examines the ideologies that were at work and details the organizational forms they inspired. During the formative years of the Italian labor movement, Neo-Thomism became the official ideology of the church. Church leadership drew upon the central Thomistic principal of caritas, Christian love, in its response to the social climate in Italy, which had become increasingly charged with class consciousness and conflict. Aquinas's principles ruled out class struggle as contrary to the spirit of Christianity and called for a symbiotic relationship among the various social strata. Neo-Thomistic philosophy also emphasized the social functions of property, a principle that demanded the paternalistic care and tutelage of the interests of working people by the wealthy. In applying these principles to the nascent labor movement, the church's leadership called for a mixed union (misto), whose membership would include both capitalists and workers. They argued that this type of union best reflected the tenets of Neo-Thomistic social philosophy. In addition, through its insistence on the misto, the church was also motivated by an obsessive concern with socialism, which it viewed as a threat, and by a fear of the working classes, which it associated with socialism, which it viewed as a threat, and by a fear of the working classes, which it associated with socialism. In pressing for the mixed union, therefore, the church leadership hoped not only to realize Neo-Thomistic principles, but also to defuse class struggle and prevent the proletariat from becoming a viable social and political force. Catholic activists, who were called upon to put ideas into practice and confronted social realities daily, learned that the "mixed" unions were a utopian vision that could not be realized. They knew that the age of paternalism was over and that neither the workers not the capitalists were interested in the mixed union. In its stead, the activists urged for the "simple" union, an organization for workers only. The conflict which ensued pitted the bourgeoisie and the Catholic hierarchy against the young activists.Sándor Agócs reveals precisely in what way Catholic social thought was inadequate to deal with the realities of unionization and why Catholics were unable to present a reasonable alternative.

This historical moment represents a caesura in labour history as it epitomises the beginning of what the editors and the contributors in this book call the internationalisation of the labour question. The case studies in this centenary volume analyse the relationship between global workers’ organisations and the new ideological confrontation between liberal capitalism, socialism and communism since the Bolshevik Revolution in Russia. Workers’ organisations, trade unions in particular, grew in importance and managed to organise internationally, forming alliances cemented by ideology and sustained by international institutional bodies or centrals. In the nascent capitalist versus communist struggle, trade unions thrived. Is it mere coincidence that today’s decline of unionism coincides with the end of ideological antagonism? The end of communism was marked by many ironies, not the least of which was the emergence of working-class movements that challenged what the party-state called "workers' paradises." Throughout eastern Europe, labor unions played a significant role in bringing about regime change, then emerged as the largest organizations in civil society.Once well-positioned to play a significant role in-if not to dominate-the postcommunist transformation of Russia, Poland, Ukraine, and Hungary (among other countries), organized labor groups have largely vanished from the stage. Examining and explaining this disjunction is the focus of Organized Labor in Postcommunist States.Paul Kubicek offers a comparative study of organized labor's fate in four postcommunist countries, and examines the political and economic consequences of labor's weakness. He notes that with few exceptions, trade unions have lost members and suffered from low public confidence. Unions have failed to act while changing economic policies have resulted in declining living standards and unemployment for their membership.While some of labor's problems can be traced to legacies of the communist period, Kubicek draws upon the experience of unions in the West to argue that privatization and nascent globalization are creating new economic structures and a political playing field hostile to organized labor. He concludes that labor is likely to remain a marginalized economic and political force for the foreseeable.

Winner of the SLS Peter Birks Prize for Outstanding Legal Scholarship 2010. The long ascendancy of pluralism and 'collective laissez-faire' as a guiding ideology of British labour law was emphatically shattered by the New Right ideology of Thatcher and Major. When New Labour was finally returned to power in 1997, it did not, however, attempt to resurrect the pre-Thatcher preference for pluralist non-intervention in collective industrial relations. Instead, it purported to follow a 'Third Way'. A centrepiece of this new approach was the statutory recognition provision, introduced in Schedule A1 TULRCA 1992. By breaking with the tradition of voluntarism in respect of recognition of trade unions, New Labour sought to provide a model of collective labour law which combined legal support with control through juridification. A closer study of both the history of approaches to recognition and the current provisions opens up fundamental questions as to the nature of this new model and the ones it aimed to replace. This book uses political philosophy to elucidate the character of those historical approaches and the nature of the 'Third Way' itself in relation to statutory union recognition. In particular, it traces the progressive eclipse of civic republican values in labour law, in preference for a liberal political philosophy. The book articulates and defends a civic republican philosophy in terms of freedom as non-domination, the intrinsic value of democratic participation through deliberative democracy, and community. This can be contrasted with the rights-based individualism and State neutrality characteristic of the liberal approach. Despite the promise of civic community in the 'Third Way' rhetoric, this book demonstrates that the reality of New Labour's experiment in union recognition was an emphatic reassertion of liberalism in the sphere of workers' collective rights. This is the first monograph to offer a sustained critical analysis of legal approaches to trade union recognition. It will be of particular interest to labour lawyers, but also a wider audience of scholars in political philosophy and industrial relations.
