Das Verhältnis von Völkerrecht und nationalem Recht wird meist im Hinblick auf die Rezeption von Völkerrecht im nationalen Recht betrachtet. Dabei findet an vielen Stellen umgekehrt auch nationales Recht Eingang ins Völkerrecht und wird als solches in Entscheidungen internationaler Gerichte vielfach angewendet. Nils Börnsen untersucht die theoretischen Grundlagen der Anwendbarkeit nationalen Rechts im Völkerrecht anhand einer Betrachtung des Investitionsschutzrechts. Er untersucht dabei Existenz und Gestalt eines völkerrechtlichen Rechtsanwendungsrechts. Neben der Bestimmung der konkreten Rechtsgrundlagen für die Anwendung nationalen Rechts in Form von Verweisen untersucht er auch die Frage der richtigen Bestimmung und Auslegung des nationalen Rechts. Dem schließt sich eine Betrachtung der Grenzen der Anwendung nationalen Rechts im Falle von Normkonflikten zwischen Völkerrecht und anwendbarem nationalen Recht an. Hierbei kommen verschiedene rechtsordnungsinterne und -externe Kollisionsregeln einschließlich des Internationalen Ordre Public zur Anwendung.

Helene Bubrowski legt vielmehr dar, dass Investitionsschiedsverfahren und nationale Gerichtsverfahren in mannigfaltiger Weise ineinander verzahnt sind: Auf Zustandigkeitsebene besteht ein Konkurrenzverhaltnis; vor Beginn eines Schiedsverfahrens stellt sich die Frage nach dem Erfordernis der Rechtswegerschopfung und nach der Rechtskraftwirkung von Gerichtsurteilen; nach Abschluss eines Schiedsverfahrens sind staatliche Gerichte zur Aufhebung und Vollstreckung von Schiedsspruchen berufen. Bei der dogmatischen Systematisierung des Verhaltnisses der internationalen und nationalen Streitschlichtungsmechanismen nimmt die Autorin auch politische und wirtschaftliche Zusammenhange in den Blick. Die Arbeit wurde mit dem Osborne Clarke Preis fur Internationales Recht ausgezeichnet.

Zwischen der Investitionsschiedsgerichtsbarkeit und dem EuGH herrscht seit dessen Urteil in der Rechtssache Achmea ein Justizkonflikt. Das europaische Verfassungsprinzip der Autonomie kollidiert mit volkervertraglich garantierten Investor-Staat-Schiedsklauseln. Die durch den Konflikt verursachte Unsicherheit betrifft nicht nur den Investitionsschutz im Binnenmarkt. Sie stellt auch die zahlreichen Investitionsschutzabkommen zwischen EU-Mitgliedsstaaten und Drittstaaten und sogar die Handelsschiedsgerichtsbarkeit infrage. Um diese Unsicherheit zu umgehen, entwickelt Jan Philipp Koster eine kontextorientierte Lesart der EuGH-Rechtsprechung und zeigt ihre schiedsverfahrensrechtlichen Folgen auf. Abschliessend macht er einen Vorschlag, wie der Investitionsschutz im Binnenmarkt zukunftig ausgestaltet werden kann.

With the entry into force of the Treaty of Lisbon in 2009, the EU became a global actor in the field of foreign direct investment. Since then, the field of EU investment policy has been gradually shaped by numerous political changes, judgments and opinions delivered by the Court of Justice of the EU, as well as lively scholarly debate. Today, a clear division between the “internal” and “external” dimensions of EU investment policy has emerged, which constitutes the general topic of this book. Within these dimensions, additional – and sometimes contradictory – facets of the EU’s multi-layered approach to investment protection can be identified. On the one hand, EU investment policy is shifting toward a decentral approach when it comes to substantive standards of investment protection. This book provides a comprehensive study of the standard of ‘full protection and security’ (FPS) in international investment law. Ever since the Germany-Pakistan BIT of 1959, almost every investment agreement has included an FPS clause.
