Despite the recent proliferation of literature on nationalism and on social policy, relatively little has been written to analyse the possible interaction between the two. Scholars interested in social citizenship have indirectly dealt with the interaction between national identity and social programs such as the British NHS, but they have seldom examined this connection in reference to nationalism. Specialists of nationalism rarely mention social policy, focusing instead on language, culture, ethnicity, and religion. The main objective of this book is to explore the nature of the connection between nationalism and social policy from a comparative and historical perspective. At the theoretical level, this analysis will shed new light on a more general issue: the relationships between identity formation, territorial politics, and social policy. Although this book refers to the experience of many different countries, the main cases are three multinational states, that is, states featuring strong nationalist movements: Canada (Québec), the United Kingdom (Scotland), and Belgium (Flanders). The book looks at the interplay between nationalism and social policy at both the state and sub-state levels through a detailed comparison between these three cases. In its concluding chapter, the book brings in cases of mono-national states (i.e. France, Germany, Sweden, and the United States) to provide broader comparative insight on the meshing of nationalism and social policy. The original theoretical framework for this research is built using insight from selected scholarship on nationalism and on the welfare state.

L'enjeu des réflexions proposées dans ce livre est de dégager des raisons d'ordre éthique et politique permettant de justifier l'autorité du droit dans la société démocratique.Dans la mesure où les normes juridiques ont pour vocation de s'appliquer à l'ensemble de leurs destinaires et où elles impliquent dès lors une dimension d'universalisation, il importe de mesurer la validité des analyses par lesquelles les théories de l'éthique tentent de justifier le caractère universalisable des normes pratiques. Menée dans la première partie de l'ouvrage, la critique de ces analyses révèle un ensemble de difficultés qui apparaissent comme les indices du contexte d'incertitude qui caractérise les prétentions de légitimité dans la société moderne. L'institution de la démocratie peut être interprétée comme une réponse à cette situation.La recherche des justifications de la légitimité du droit doit dès lors s'orienter vers les convictions éthiques qui sont à la base de la démocratie et qui s'expriment dans les impératifs conjoints d'égalité et d'autonomie collective. Cette recherche forme l'objet de la seconde partie du livre. Après avoir évoqué les principes fondateurs de la démocratie et les interprétations divergentes qu'ils ont suscitées, l'auteur envisage les problèmes que posent la formation de la volonté collective dans la société démocratique, l'intégration de la communauté politique et, enfin, les justifications du caractère obligatoire des règles de droit.À la faveur d'une réflexion théorique sur les conditions de légitimité du droit, l'ouvrage aborde un ensemble de questions actuelles qui constituent autant de défis pour la philosophie politique et qui concernent, entre autres, les finalités de la démocratie, les relations que celle-ci entretient avec le libéralisme, la portée des droits fondamentaux, la rationalité des procédures de décision collective, la protection des minorités et le sens de la citoyenneté dans les sociétés pluriculturelles.
