The International Law Commission, when drafting articles on nationality of persons in situations of State succession, omitted cases of unlawful territorial changes. These do not result in State succession; they may be dealt with under the rubric of State continuity. The Baltic – Russian cases show the particularly complex nature of these situations, both as concerns agreement on continuity and decisions on nationality. The author examines in detail the Citizenship Laws of the Baltic States and Russia, as well as relevant constitutional and international statements about the international legal status of the States and responses of the international community thereto. The main question addressed in the book is about solutions which States have to adopt concerning nationality of individuals in situations of State continuity, especially where States re-emerge after long years of occupation. Although the book is specific in its origin, it is of general importance because it draws conclusions concerning developments in law and practice which are relevant for a better understanding and regulation of nationality and statehood in international law.

The break-up of the Soviet Union in 1989 left 25 million Russians living in the 'near abroad', outside the borders of Russia proper. They have become the subjects of independent nation-states where the majority population is ethnically, linguistically, and often denominationally different. The creation of this 'new Russian diaspora' may well be the most significant minority problem created by the dissolution of the Soviet Union. Paul Kolstoe traces the growth and role of the Russian population in non-Russian areas of the Russian empire and then in the non-Russian Soviet republics. In the post-Soviet period special attention is devoted to the situation of Russians in the Baltic countries, Moldova, Belarus, Ukraine and the former Central Asian and Caucasian republics. A chapter written jointly by Paul Kolstoe and Andrei Edemsky of the Institute of Slavonic and Balkan Studies, Russian Academy of Sciences, delineates present Russian policy toward the diaspora. Finally, Kolstoe suggests strategies for averting the repetition of the Yugoslav scenario on post-Soviet soil.

In 1968, the predecessor of this volume was published as Number 15 of the Law in Eastern Europe series, under the title "Soviet Citizenship Law". The decision to put out a new version of that study was prompted by the enactment in 1978 of the CUTTent Law on the Citizenship of the USSR and the various changes in Soviet prac tice in this domain which occurred in the intervening decade. I have drawn on the earlier work for background material and in order to make comparisons between the previous record here and the substance ofthe latest statute. However, the pres ent monograph is not a second edition in the sense of being an expanded and updated revision of the original, but stands as an independent piece of research and analysis. Thus, three of the chapters (out of a total of six) featured in the 1968 vol urne - citizenship and state succession, state succession and option of nationality, and refugees and displaced persons - have now been omitted for the simple reason that the situation in these areas has remained virtually static during the past ten years so that the initial treatment requires no significant alteration. On the other hand, fresh problems have meantime arisen - such as, for instance, the connection between citizenship and emigration, and the relationship between citizenship status and the international protection of human rights - which called for attention and are dealt with in this book.
