What defines the social practices we currently call norms? They make theft forbidden, eating with a fork advisable, and paintings beautiful. Norms are commonly thought of as moral justifications for doing one thing and not doing another. They are also described in terms of their outcomes or effects, serving as mere causal explanations. The Possibility of Norms proposes a broader view of how norms function, how they are articulated, and how they are realized. It may be asking too much if we expect norms to be effective or morally right. Many norms are simply ineffective and many are at most ineffectively justifiable. Drawing upon a rich array of texts - from law and jurisprudence to philosophy, aesthetics, and the social sciences - Möllers argues for conceiving of social norms as positively marked possibilities. Positively marking a possibility indicates that it should be realized. Normativity thus hinges on judging the world from a distance and acknowledging the possibility of divergent states of the world. Hence, it is no longer theoretically problematic that there are morally unjustified norms, nor that norms can be broken. On the contrary, allowing for breaches may be an important feature of normativity. Möllers's conceptual study sheds new light on a range of paradigms in the humanities, social sciences, and cultural studies, reframing several aspects of norm theory and questioning the theoretical assumptions underlying existing empirical work on normativity.

Diese Darstellung ist am Gegensatz von Rationalismus und Empirismus orientiert, der sich in der Ethik in den gegensätzlichen Ansätzen der Verstandes- und Gefühlsmoralisten zeigt. Im Rahmen einer Auseinandersetzung mit klassischen Positionen aus der Geschichte der Ethik versucht Husserl, die Grundlagen seiner eigenen Ethik zu gewinnen und darin die traditionellen Gegenüberstellungen zu versöhnen. So steht für Husserl die Gefühlsgrundlage der Moral nicht im Widerspruch zur Idee eines absoluten Sollens, an der Husserl im Anschluss an Kant und Fichte festhält. Husserls Ausführungen gipfeln in dem Ideal eines universalen vernunftbestimmten Willenslebens, in dem alle Aktsetzungen endgültig zu rechtfertigen wären. Zur Vorlesung gehört ein umfangreicher Exkurs, in dem Husserl durch eine phänomenologische Analyse des Unterschieds zwischen Sach- und Normbegriffen den wissenschaftstheoretischen Charakter der Ethik als normativer Geisteswissenschaft bestimmt.

This book – which is the result of several years of research, discussion, writing and re-writing – consists of three parts and eight chapters. The rst part is given by the two rst chapters introducing the issue of validity and facticity in law. The second part (Chapters 3, 4 and 5) is the core of this study and tries to present a theory based on a speci c view about language and social practice. The third part deal with the issue of value judgments and views about morality and consists of Chapters 6 and 7. Chapter 8 should nally serve as epilogue. In the rst chapter a discussion is started about the relationship between law and power, seen as a presupposition for an assessment of the nature of law. As a matter of fact, as has been remarked, “general theories of law struggle to do justice to the 1 multiple dualities of the law”. Indeed, law has a “dual nature”: it is a fact, but it also a norm, a sort of ideal entity. Law is sanction, but it is also discourse. It is effectivity, or facticity, but it is also a vehicle of principles among which the central one is justice. But this duality is not only a phenomenological, or a matter of justi cation and implementation as two separate moments.
