El actual empleo generalizado de la anestesia en toda intervención quirúrgica o acto médico invasivo, sumado al dato de que las técnicas anestésicas comportan per se riesgos intrínsecos, hacen que el ejercicio de la especialidad anestesiológica sea fuente inagotable de pleitos de responsabilidad civil por daños. A luz de la más autorizada doctrina sobre responsabilidad médica y con el banco de pruebas de la copiosa jurisprudencia sobre el tema, este libro —de triple interés, tanto para juristas como para pacientes y médicos— se centra en las singularidades que, en el ámbito anestésico, presenta la interpretación y aplicación de la normativa general reguladora de la responsabilidad civil (principalmente extracontractual, ex art. 1902 CC). Desde las premisas de que la obligación del anestesista es de medios y del carácter subjetivo o culpabilístico de su responsabilidad, y teniendo en cuenta la habitual actuación de este especialista dentro de un equipo médico-quirúrgico, se ofrece un análisis pormenorizado de los principales supuestos de mala praxis y negligencias anestésicas con resultado lesivo para el paciente; análisis que, amén de una referencia al papel de los protocolos médicos, se estructura en función del respectivo contenido de la lex artis en cada uno de los tres estadios de intervención de dicho profesional: cuidados preanestésicos, fase de peranestesia (o anestesia stricto sensu) y reanimación o postanestesia. Por otra parte, y tras ponerse sobre el tapete la operatividad en anestesiología de la teoría del «daño desproporcionado», el libro concluye con un estudio particular de la repercusión que el consentimiento informado del paciente, de conformidad con la Ley 41/2002, despliega en sede de responsabilidad civil anestésica.
