Excerpt from Brief View of the Constitution of the United States: Addressed to the Law Academy of Philadelphia The method which I have followed to attain the oh jcet which I had in view, is, I believe, entirely new. I do not by any means pretend that it is preferable to that which has been adopted by other writers; I only can say that I found it better suited to my purpose, which I have already explained. Had I written with other and more ambitious views, I would, of course, have endeavoured to adapt my method to them, as our great writers on the constitution have very properly and successfully done. The Constitution Of The United States written by Thomas James Norton and has been published by Forgotten Books this book supported file pdf, txt, epub, kindle and other format this book has been release on 2017-10-12 with Political Science categories.

Americans of all political points of view often discuss the U.S. Constitution, but how well do they really know the document and its history? The Constitution the United States: Its Sources and Its Application gives the reader a crash course in the text of the Constitution and its sources. Thomas James Norton was a lawyer who argued before several high courts of appeals, and in this book his goal is to provide an annotated copy of the U.S Constitution so that readers could better understand the reason for each section. As Norton's annotations make clear, one cannot understand the Constitution without understanding the basics of the earlier 'Articles of Confederation', its strengths and weaknesses and why it ultimately failed. The Articles created a weak central government, which The Constitution sought to rectify without tipping the balance too strongly in favour of a mighty centralised government. The footnotes reveal the debate and compromise which led to the passage of each individual clause. Key historical moments, such as the reign of King Charles I of England and the Short Parliament, are added to the text to explain how they shaped the attitudes of the men who wrote the Constitution. Norton also discuses the governments of Australia, France, Canada and Brazil for comparative purposes, which really enriches the experience for readers who are not well versed in comparative government. These explanations are brief, which keeps the book moving at a brisk pace. Norton occasionally expresses strong opinions about historical events which may not be in line with how American constitutional history actually unfolded in the future, but his opinions do not interfere with the usefulness of the book. The Constitution the United States: Its Sources and Its Application is not overly technical and does not rely strictly on legal language. This makes the book digestible by everyone, from lawyers to historians to people interested in politics. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Excerpt from The Constitution and Public Opinion I. Extreme rigidity in our federal and state constitutions. Amendment is made as difficult as possible; in some states it is practically impossible. The assumption of constitution makers seems to have been that eternal wisdom was possessed by the generation entrusted with the making of the constitution, and that the results of their labors should be crystallized into perma nent, unchanging form. Excerpt from Political and Constitutional Law of the United States of America The principles fundamental to political self-government, should doubtless be clearly understood by every vo'rnn or macros. For his status, in this country, is no less than that of one of a body of absolute sovereigns.l The three fundamentally different and mu tually opposing theories of our political system, - one or another of which every voter must necessarily sanction, and consequently, -one or another of which must furnish the key to every administra tion of government, state and federal, - are therefore severally and distinctly presented, so that every voter may judge for himself, as he ought to do, which of these theories should receive his assent and support. Attention is also directed to the different foundations of govern ment, to the rise and development of the system peculiar to Amer ica, to the sovereign legislation by the People themselves from the dawn of the Revolution to the xvth Amendment, and to the views and doctrines of the original framers of our Constitutions; ever so little reflection upon which will enable any voter to form his own independent opinion, regardless of partisan strifes, and to cast his vote with a clear understanding of what it involves. Excerpt from The Framing of the Constitution of the United States For over ten years the writer has been engaged in collecting and editing the material available upon the work of the convention that framed the constitution of the United States. Collating of texts is a wearisome and often merely a mechanical task, but in the process the editor becomes more or less familiar with the content of the documents. In the present instance the form in which the work finally shaped itself required a knowledge of the proceedings of the convention not merely as a whole, but from day to day, and it necessitated a familiarity with the thought and expressions of the individual members. When to this was added an acquaintance with the personalities of the more important delegates, a mental picture of the convention was formed which developed into a conviction as to what the delegates were trying to do and what they actually accomplished. It is with no idea of attempting the final history of the formation of the constitution that the present book is written. Excerpt from Reflections on the Changes Which May Seem Necessary in the Present Constitution of the State of New York The formation or revision of a constitution is as noble a task as the erection of those great cathedrals, toward the rearing of which it was the habit of calling on every one to contribute his share of work or means, however humble it might be and in obedience to your call I shall cheerfully offer my contribution to the building up of our constitution or at least I shall write my views as to the principal points to be looked to in the formation of a new constitution, to use the words of the resolution which you have communicated to me, distinctly understanding that the Club, in publishing my views, makes itself in no way answerable for them, but gives them as the Opinions of a fellow-citizen on subjects of great public interest. Demosthenes, in one of his great speeches, mentions the daily and hourly repeated Athenian question, And what's the news? Let me consider the call of our Club like the frequent American question, What do you think about this matter - put more solemnly, more singling out, indeed, but still addressed by friends to a friend. I beg you, dear sir, to convey my sincere thanks to the Club, and to assure our fellow-members that, however unsuccessful I may be, or however my convictions may occasionally differ from the views of some of them, I shall write down what they have asked for, conscious of the weighty importance attached to the topic, and that not a line will be written either from the love of some theory, or in the temper of a partisan, or in the pliable Spirit of a courtier to his sovereign, although the sovereign with us be called the people. Accept for yourself the assurance of my highest esteem, and believe me, Dear sir, Very truly yours, francis lieber. To john jay, Esq, President of Union League Club, New York.
