Scientists who require multiple quot;research toolsquot; (i.e., laboratory resources such as transgenic animals and biological receptors) to develop new drugs and medical diagnostic products are frequently finding that these tools are patented or subject to other proprietary constraints. Stacking royalty obligations and heightened transaction costs resulting from the proliferation of patents on research tools threaten to slow or stop the development of new drugs and devices critical to public health. Because U.S. courts have very narrowly interpreted the common law quot;experimental usequot; defense of patent law as limited to quot;dilettantequot; uses of inventions for mere quot;amusementquot; or ''philosophical'' inquiry, scientists face the daunting choice of either negotiating numerous licenses or risking the possibility that their research and development will be enjoined. In response to this dilemma of mounting transaction costs and increasingly restricted access to patented research tools, this Article argues for a broadened rule of quot;development usequot; that would permit scientists to use certain patented research tools without prior authorization, but require that the research tool patent owner be paid an ex post royalty based on the ultimate commercial success of the new drugs or other products developed through use of the tool. This quot;reach-throughquot; royalty approach maintains incentives for the development and patenting of new research tools, but alleviates the access restrictions and up-front costs currently associated with their acquisition and use.

Richard A. Epstein looks closely at the regulatory framework that surrounds all aspects of making pharmaceutical products today, and he assesses which current legal and regulatory practices make sense and which have gone awry. While critics of pharmaceutical companies call for ever more stringent controls on virtually every aspect of drug development and approval, Epstein cautions that the effect of such an approach will be to stifle pharmaceutical innovation and slow the delivery of beneficial treatments to the patients who need them. The author considers an array of challenges that confront the industry--conflicts of interest among government, academe, and the drug companies; intellectual property rights that govern patents; FDA regulation; pricing disputes; marketing practices; and liability issues, including those brought to light in the recent VIOXX case. Epstein argues that to ensure the continuing creativity, efficiency, and success of the pharmaceutical industry, the best system will feature strong property rights and clearly enforceable contracts, with minimal regulatory and judicial interference.

The French writer, editor, and drama critic Jacques Copeau (1879–1949) opened his Théâtre du Vieux-Colombier in Paris in 1913. Copeau was well on his way to exerting a major influence in the theater in the year that saw the end of the career of the dominant innovator of an earlier generation, André Antoine, whose Théâtre Libre (Free Stage) had featured an uncompromising realism. In marked contrast to Antoine, Copeau returned the poetry and freshness to Shakespeare and Moliére. By May 1914, Paris and Europe had recognized his genius and his special gift to the theater. Yet like Antoine, Copeau wanted to sweep "staginess" from the stage, to banish overacting, overdressing, and flashy house trappings. To cleanse the stage of its artificiality, he created a fixed, architectural acting space where dramatic literature and theater technique could live in harmony and thrive in freedom of thought and movement. A major part of his program was teaching actors and actresses their craft. Maurice Kurtz points out that the Théâtre du Vieux-Colombier incarnates the "ideal of Copeau's stubborn struggle to remain strong in the face of indifference, independent in the face of success, proud in the face of defeat.
