El derecho del trabajo se distingue de las otras disciplinas jurídicas y se rebela incluso a la división del Derecho en las dos ramas del derecho público y privado—división que está lejos de ser clara—, por una razón que constituye también el principio de unificación de sus tres partes, aparentemente heterogéneas: dos de las cuales pertenecen fundamentalmente al derecho privado (la disciplina de la autonomía colectiva y la de la autonomía individual) y una al derecho público, la disciplina de la previsión y asistencia social. La razón está en la implicación de la persona del trabajador en el trabajo prestado a otros. La disciplina de la previsión y asistencia social tiende aún a separarse del derecho del trabajo, por su progresiva extensión a la generalidad de los sujetos. La persona del trabajador está implicada en la actividad prestada a otros, tanto por la subordinación del trabajador al empresario y su entrada en la empresa, como por la dependencia de la vida del trabajador y de su familia de la retribución, que es su único medio de sustento. Todo el derecho del trabajo está característicamente ordenado a este fin, a la tutela de la libertad, o más bien de la misma personalidad humana del trabajador, ligado por un vínculo que, entre todos los vínculos de contenido patrimonial, es el único que coloca, aunque sólo sea por necesidad institucional, a un sujeto bajo la dependencia de otro sujeto. Esa tutela marca el límite del respeto al interés del empresario. Para realizarla no bastan los auxilios comunes del derecho privado, informados por el concepto de la igualdad de los particulares, que aquí no encuentra correspondencia en la realidad económica y social, sino que ayudan instituciones peculiares, sin aplicación ni oportunidad para ninguna de las otras relaciones patrimoniales, siendo necesarios también los auxilios del derecho público.
