In 1990, after the end of the Pinochet regime, the newly-elected democratic government of Chile established a Truth and Reconciliation Commission (TRC) to investigate and report on some of the worst human rights violations committed under the seventeen-year military dictatorship. The Chilean TRC was one of the first truth commissions established in the world. This book examines whether and how the work of the Chilean TRC contributed to the transition to democracy in Chile and to subsequent developments in accountability and transformation in that country. The book takes a long term view on the Chilean TRC asking to what extent and how the truth commission contributed to the development of the transitional justice measures that ensued, and how the relationship with those subsequent developments was established over time.It argues that, contrary to the views and expectations of those who considered that the Chilean TRC was of limited success, that the Chilean TRC has, in fact, over the longer term, played a key role as an enabler of justice and a means by which ethical and institutional transformation has occurred within Chile. With the benefit of this historical perspective, the book concludes that the impact of truth commissions in general needs to be carefully reviewed in light of the Chilean experience. This book will be of great interest and use to students and scholars of conflict resolution, criminal international law, and comparative legal systems in Latin America.

Where do strong conservative parties come from? While there is a growing scholarly awareness about the importance of such parties for democratic stability, much less is known about their origins. In this groundbreaking book, James Loxton takes up this question by examining new conservative parties formed in Latin America between 1978 and 2010. The most successful cases, he finds, shared a surprising characteristic: they had deep roots in former dictatorships. Through a comparative analysis of failed and successful cases in Argentina, Chile, El Salvador, and Guatemala, Loxton argues that this was not a coincidence. The successes inherited a range of resources from outgoing authoritarian regimes that, paradoxically, gave them an advantage in democratic competition. He also highlights the role of intense counterrevolutionary struggle as a source of party cohesion. In addition to making an empirical contribution to the study of the Latin American right and a theoretical contribution to the study of party-building, Loxton advances our understanding of the worldwide phenomenon of "authoritarian successor parties"parties that emerge from authoritarian regimes but that operate after a transition to democracy. In most Latin American countries, key officials and political figures have been involved in big corruption scandals in the last decade, leading to a rigorous academic debate on the possible socio-economic, political and cultural factors responsible for corrupt practices across the region. This book takes a different approach by focusing on Chile, which shows the lowest levels of corruption in the region. Instead of analysing notoriously bad cases in Mexico, Argentina, Brazil and Venezuela, this book explores the factors which have led to a relatively high degree of public probity among power holders in Chile. Public Probity and Corruption in Chile presents a long-term historical analysis demonstrating that public probity in Chile has its roots in the colonial period, and that public and state responses have historically shown a low level of tolerance for public cases of corruption. In particular, the author highlights the role played by relative poverty and lack of resources, geographical remoteness, the impact of the Arauco War against the Mapuche people, the militarisation of both government and public administration, the extreme oligarchic nature of the Chilean aristocracy, the early consolidation of state institutions and the rule of law, high levels of political stability and the role played by patriotism. Studying an example of better practice in detail in this way provides valuable insights into the factors and actors which can help to prevent or to revert the phenomenon of public corruption in the region more generally. During the seventeen-year Pinochet dictatorship, more than three thousand Chileans were murdered or disappeared without a trace. In 1991, a year after the brutal military regime ended, the new civilian government tasked the nation's detective force to investigate these crimes. Chilean journalist Pascale Bonnefoy tells the dramatic story of the detectives who hunted down and attempted to bring human rights violators to account. Led by a tiny group called Department V, the effort took place in the context of a frail transition to democracy and while the force itself was undergoing profound reforms. With Pinochet still in charge of the army, a center-left government tested how far it could go to bring criminals to justice without risking military backlash. To uncover this story, Bonnefoy gained the trust of detectives assigned to the cases and drew on their direct testimony. She excavated investigative files, witness testimony, and previously secret documents that helped her chronicle the dedicated brigade's dangerous mission. While substantial justice and institutional change took another decade to kick in, the detectives' work made it possible. Still unfolding, the post-Pinochet example is admired by many working for transitional justice around the globe.
