O tipo legal do art. 171o, nos 1 e 2, do Código Penal, está tipicamente estruturado como um crime de perigo abstrato, na base da dupla presunção legal de que os menores de 14 anos não têm capacidade de autodeterminação sexual e de que, por força dessa incapacidade, a sua participação em práticas sexuais, ainda quando não forçadas, prejudica o livre desenvolvimento da sua personalidade, em particular na esfera sexual. Neste estudo testa-se a consistência das presunções legais em que a incriminação se apoia, analisa-se a relação entre o acordo e a estrutura do delito, problematiza-se a constitucionalidade daquele tipo legal, avaliando a discricionariedade do legislador na forma como tutela os bens jurídicos e, finalmente, pondera-se sobre a possibilidade/necessidade de tipificação de um critério complementar da idade no recorte do mesmo tipo legal.
