O autor parte da crise do pensamento filosófico nos séculos XIX e XX e da influência que passaram a exercer Comte e Kant sobre todas as áreas da cultura, em especial sobre o mundo do Direito. O positivismo jurídico, instalado a partir daí, deu fundamentação doutrinária ao domínio político de déspotas como Hitler, Mussolini e Stálin, que levaram o mundo a duas guerras mundiais. No final da segunda dessas guerras, os vitoriosos concluíram pela necessidade de julgar os líderes vencidos; o julgamento realizado em Nürnberg não pode, todavia, respeitar os estreitos limites da lei positiva, o que acordou o mundo jurídico para a necessidade de buscar nas leis naturais a solução dos mais graves crimes da humanidade. Assim retornou-se, na segunda metade do século XX, às ideias do jusnaturalismo que os velhos gregos já haviam descoberto nas tragédias e nos debates filosóficos, mas que o positivismo jurídico pretendera apagar. Este retorno foi beneficiado pelo recente desenvolvimento da axiologia. A Justiça deixa de ser vista, então, pelo autor, apenas como virtude ou sentimento e passa a ser analisada como um valor na escala axiológica, uma espécie do bem nas relações sociais. A partir das ideias do jusfilósofo brasileiro Armando Câmara, é analisado o conceito de Justiça como conformidade das relações interpessoais com os fins da vida enquanto convívio, ou com o bem comum. As considerações metafísicas sobre relação e sobre bem comum revelam, então, o essencial do conceito de justiça. Enfrenta, finalmente, o autor, o reiterado conflito entre e ser e dever ser, para encontrar solução no homem, como um ser-que-deve-ser. Culmina, assim, o trabalho com a tese do Direito como técnica que visa à realização do homem; que, ao apontar ao homem os fins sociais da vida como modeladores da conduta justa e exigir que sejam respeitados, coloca-o no rumo da realização de seus fins últimos.
