A presente obra objetiva analisar os ilícitos penal e administrativo, demonstrando que ambos possuem a mesma natureza sancionatória, na medida em que têm por finalidade precípua a proteção de bens jurídicos. É sabido que com a inserção do Direito Administrativo Sancionador ao ordenamento jurídico brasileiro, houve a criação de tipos, por vezes idênticos àqueles previstos no Direito Penal, o que permitiu que o cidadão fosse submetido a mais de uma persecução e, consequentemente, a mais de uma sanção em decorrência de fatos idênticos, na contramão do que impôs a garantia do ne bis in idem. Isso porque, é certo que o Estado não pode dar ao mesmo fato delituoso mais de uma resposta, sob pena de submeter o indivíduo a uma situação jurídica indefinida, indigna de sua condição humana. Em que pese, diante de uma mesma esfera seja facilmente admitida a incidência do ne bis in idem como forma de impedir que diversos órgãos da administração, por exemplo, apliquem dupla sanção ao indivíduo, infelizmente tal entendimento não predomina quando se tem em conta que uma mesma ação produza reflexos tanto na seara administrativa quanto penal, sob o argumento de que, neste caso, as esferas seriam independentes. No entanto, não obstante o fato de que os ilícitos, por vezes, encontram previsão em esferas distintas, é certo que o Direito Administrativo Sancionador, assim como o penal, integra o ius puniendi do Estado, razão pela qual sobre aquele deverá incidir os mesmos princípios reguladores deste. Assim, faz-se necessário verificar se há entre as normas ditas violadas, uma identidade no conteúdo do injusto, ainda que estas se refiram a normas de naturezas distintas, como a penal e a administrativa, de modo que, em havendo identidade de fatos, de sujeitos e de fundamento, traduzido este na identidade de conteúdo material entre os ilícitos concorrentes, há que se optar pela sanção do cidadão por uma via ou outra, sob pena de se ofender direitos fundamentais e incorrer em bis in idem. A obra traz diversos julgados sobre o tema e analisa, ainda, precedentes de cortes internacionais, com o objetivo de demonstrar a constante violação à garantia do ne bis in idem pelos tribunais pátrios.
