Não há na doutrina de direito bancário um aprofundamento e uma relação robusta com os princípios jurídicos que podem ser aplicados em diversas ações judiciais, limitando muitos a discorrerem somente sobre a legislação em si, sendo assim, possibilitando uma maior abrangência do operador do Direito nos casos concretos. As revisões de cláusulas contratuais, principais ações bancárias nos dias atuais, embora tenham sido restringidas em alguns pontos pelo Poder Judiciário, como a famigerada "legalidade" do anatocismo e a capitalização diária possível, se expressa, ainda contemplam sua legitimidade, ligadas ao direito de ação, haja vista que ainda consumam-se cláusulas que não deveriam ser inseridas nos respectivos contratos, e contabilidades aplicadas que não observam até mesmo o contrato posto, quando periciados, sendo, portanto, as ações revisionais de cláusulas de contratos bancários legítimas no mundo jurídico, embasadas em diversos princípios constitucionais, sob a nova ótica constitucionalista do direito civil e do processo civil, em que neste trabalho o fim é a abertura desse leque de possibilidades de defesas dos consumidores lesados.

This book focuses on recent developments in consumer law, specifically addressing mandatory disclosures and the topical problem of information overload. It provides a comparative analysis based on national reports from countries with common law and civil law traditions in Asia, America and Europe, and presents the reports in the form of chapters that have been drafted on the basis of a questionnaire, and which use the same structure as the questionnaire to allow them to be easily compared. The book starts with an analysis of the basic assumptions underlying the current consumer protection models and examines whether and how consumer models adapt to the new market conditions. The second part addresses the information obligations themselves, first highlighting the differences in the reported countries before narrowing the analysis down to countries with a general pre-contractual information duty, particularly the transparency requirements that often come with such a duty. The next part examines recent developments in the law on food labelling, commercial practices and unfair contract terms in order to identify whether similar traits can be found in European and non-European jurisdictions. The fourth part of the book focuses on specific information obligations in the financial services and e-commerce sectors, discussing the fact that legislators are experimenting with different forms of summary disclosures in these sectors. The final part provides a critical appraisal of the recent developments in consumer information obligations, addressing the question of whether the multiple criticisms from behavioural sciences necessitate abandonment or refinement of current consumer information models in favour of new, more adequate forms of consumer protection, and providing suggestions.

O período de transição da escravatura para o trabalho livre no Brasil (1888-1889) fez com que uma nova política econômica de caráter expansionista fosse executada. Com abundante oferta de crédito e maior emissão de numerário, uma bolha especulativa formou-se no Rio de Janeiro, centro financeiro do país nesse período. A especulação iniciada em um momento de euforia, ainda no Império, estourou nos primeiros anos da República (1891). Essa crise financeira ficou conhecida como o Encilhamento, que perdurou por uma década. O mercado bancário brasileiro foi severamente atingido pela crise do Encilhamento, sendo que poucas instituições financeiras sobreviveram após 1900. Os bancos de Minas Gerais, que participaram intensamente dessa conjuntura, não ficaram indiferentes a esse processo. Somente um banco, o Crédito Real de Minas Gerais, resistiu incólume ao Encilhamento, sendo que, entre 1896 e 1909 nenhum estabelecimento bancário foi inaugurado nesse Estado. Em 1903, na cidade de Belo Horizonte, aconteceu o Congresso Agrícola, Industrial e Comercial de Minas Gerais. As teses apresentadas nesse encontro, com o objetivo de diagnosticar e solucionar o quadro negativo em que a economia mineira se encontrava, devido às consequências das crises financeiras da primeira década republicana, geraram as diretrizes de uma nova dinâmica no setor bancário mineiro.
