O estudo do Estado e de sua atuação na sociedade consiste em uma tarefa de extrema importância para os estudiosos das ciências jurídicas. A própria existência do direito e de sua efetividade social depende do braço forte do Estado que é titular do monopólio da força. O Estado, em síntese, consiste em uma organização social e política responsável pela curatela do interesse coletivo. Em razão deste fato, as relações com seus súditos são caracterizadas pela supremacia da vontade estatal sobre o interesse privado. Embora se trate de relações entre partes desiguais, não é autorizado ao Estado agir em desconformidade com as regras colocadas pelo Direito. O chamado estado democrático de direito atua como inibidor dos rompantes arbitrários do ente estatal. O direito administrativo é um dos muitos braços do direito público e consiste na busca pela compreensão dos princípios e normas que são aplicáveis às atividades desempenhadas pelo Poder Público. É imperioso reconhecer que a supremacia do interesse público sobre o particular consiste na essência do direito administrativo brasileiro, tendo sua presença em diversos institutos e normas administrativistas. Dentro da estrutura da administração pública figura o agente público que, segundo a legislação, é qualquer indivíduo que exerce uma atividade pública decorrente de mandato, cargo, emprego, função ou qualquer outra forma de investidura. O desempenho das atividades dos agentes públicos se sujeita a um processo de supervisão e fiscalização realizado pela própria administração pública visando corrigir falhas e penalizar eventuais culpados. O chamado poder disciplinar da administração é uma prerrogativa estatal que visa coibir condutas ilícitas realizadas por um grupo de agentes públicos. A presente pesquisa, embora modesta, busca explorar as nuances desta prerrogativa, bem como suas limitações impostas pelo estado democrático de direito. Deseja-se a todos uma leitura agradável e bons estudos.
