O tema da liberdade na filosofia de Immanuel Kant é apresentado sob três aspectos: o primeiro decorre da passagem da ideia da metafísica clássica para a ideia da crítica, momento em que Kant estabelece o primeiro conceito da liberdade, ou seja, a liberdade negativa. O segundo aspecto decorre quando Kant estabelece as fórmulas do imperativo categórico, com objetivo de nortear as ações racionais com base no dever; nessa perspectiva, Kant se preocupa com a liberdade prática, ou seja, a liberdade positiva. Por fim, o terceiro aspecto da liberdade se concretiza quando o Direito delimita as ações externas, de modo que a legalidade jurídica voltar-se-á para o controle da liberdade externa, enquanto a moralidade se ocupará da liberdade interna. Nessa perspectiva, o conceito da liberdade é apresentado pelo prisma do criticismo kantiano que se encontra problematizado em diversas obras do filósofo.

When Freud wrote his classic Civilization and its Discontents, he was concerned with repression. Modern civilization depends upon the constraint of impulse, the limiting of self expression. A total institution is defined by Goffman as a place of residence and work where a large number of like-situated, individuals, cut off from the wider society for an appreciable period of time, together lead an enclosed, formally administered round of life. Prisons serve as a clear example, providing we appreciate that what is prison-like about prisons is found in institutions whose members have broken no laws. This volume deals with total institutions in general and, mental hospitals, in particular. The main focus is, on the world of the inmate, not the world of the staff. A chief concern is to develop a sociological version of the structure of the self. Each of the essays in this book were intended to focus on the same issue--the inmate's situation in an institutional context. Each chapter approaches the central issue from a different vantage point, each introduction drawing upon a different source in sociology and having little direct relation to the other chapters. This method of presenting material may be irksome, but it allows the reader to pursue the main theme of each paper analytically and comparatively past the point that would be allowable in chapters of an integrated book. If sociological concepts are to be treated with affection, each must be traced back to where it best applies, followed from there wherever it seems to lead, and pressed to disclose the rest of its family.

O trabalho revela a importância da filosofia retórica para o direito ao depurar por análises críticas tentativamente isentas a distorção que a dogmática promove sobre a interpretação das normas. É nesse sentido que se enfrenta a liça da Repercussão Geral no 1.087 do STF, sobre a aventada hipótese de violação da soberania dos veredictos quando um tribunal de segundo grau cassa uma absolvição genérica contrafática. Dentro das teorias da argumentação jurídica, a proposta cética de análise do conflito entre juspositivistas e jusnaturalistas, destacam-se as falhas dos discursos de setores da Defensoria Pública, da Advocacia Criminal e do Parquet. Além disso, aponta por que as soluções hermenêuticas propostas pelo substancialismo que marca a jurisdição neoconstitucional são ilusórias. Com esse propósito, a pesquisa: a) afasta-se dos critérios de ponderação de princípios em conflito; b) denuncia a lógica binária que norteia a phrónesis do direito; c) suspende (epoché) a ética dos discursos dogmáticos e jurisprudenciais; e d) promove a ampliação analítica do debate investigando interferências epistemológicas do rito sobre o livre arbítrio dos leigos. Propondo uma interpretação zetética, enfrenta-se o tema a partir dos três níveis retóricos (dýnamis, téchne e epsteme), investigação tópica que destacará um importante entimema sobre todo conflito travado, demonstrando falhas da presunção de vontade nas isoladas, injustificáveis e incognoscíveis absolvições genéricas do Júri.
