No que tange aos empregados domésticos, não obstante o cerne da relação de trabalho esteja atrelado à contratação, para realização de atividade sem fins lucrativos, a peculiaridade desses contratos não os torna menos desiguais aos demais. Além disso, em se tratando de trabalhadores domésticos, a luta por melhores condições de trabalho torna-se muito mais penosa. As razões vão desde dificuldades de organização coletiva (derivada da pulverização do trabalho) ao estigma de subempregado: indivíduos exercentes de profissões historicamente direcionadas a escravizados. O presente estudo tem como objetivo principal buscar compreender a motivação pela qual, embora formalmente direcionada à correção de distorções históricas, a Lei Complementar 150/2015, popularmente conhecida como a “Lei das Domésticas”, não contemplou aos empregados domésticos todos os direitos e garantias previstos aos demais trabalhadores na Constituição Federal. Ou seja, porque, afinal, optou-se por fazer manter os trabalhadores domésticos na marginalização legal. Impende-se verificar se esta omissão legislativa - intencional ou não -, assim como ocorreu às normas especializadas já revogadas, resultou, unicamente, da ausência de técnica legislativa ou se esse tratamento desigual decorre de um traço genético e resistente da sociedade brasileira.
