The invasion and occupation of Iraq has attracted significant legal interest. A year after Coalition forces invaded Iraq, debate over the legality of that use of force shows no sign of abating. Coalition forces also face intense scrutiny over their obligations as occupying powers. This paper explores the powers and duties of occupiers under international law. The nature and scope of these norms is assessed by reference to a variety of sources of international law including (i) the classic treaties on occupation, (ii) customary law, (iii) applicable UN resolutions and (iv) relevant domestic law. In assessing the fundamental obligations of the occupying forces in Iraq, the following questions are addressed: 1. What are the powers and obligations of occupying forces under contemporary international law? 2. Do the occupied retain sovereignty over their state during a belligerent occupation? If so, how if at all may they exercise these rights? 3. What mechanisms (if any) exist to ensure compliance by occupying forces with their obligations? 4. Do the occupying powers have a legal mandate to fulfil a reformist agenda in Iraq that includes the reshaping of national institutions? 5. Is it realistic to expect coalition forces to meet all of their obligations under the law of occupation in a complex and dangerous environment of competing interests and needs? 6. Do occupying powers have a duty to ensure that sufficient troops and resources are deployed to protect the civilian population, prevent looting, guard infrastructure and maintain public order in the 'post conflict' phase?' Tensions between the law of occupation, Security Council Resolution 1483, and Coalition practice in Iraq are also highlighted. In addition, existing mechanisms for ensuring the accountability of occupying powers for non-compliance with their obligations under the law of occupation are assessed. The paper concludes by asking whether the international law of occupation offers an adequate legal framework for regulation of belligerent occupation in the 21st century.

Occupation and Insurgency details German policies towards civilians and captured military forces in the Soviet Union from 1941-1945 and examines them in the context of the laws of war. Few would contest that the U.S. occupation of Iraq is a clear example of just how fraught a military occupation can become. In Occupational Hazards, David M. Edelstein elucidates the occasional successes of military occupations and their more frequent failures. Edelstein has identified twenty-six cases since 1815 in which an outside power seized control of a territory where the occupying party had no long-term claim on sovereignty. In a book that has implications for present-day policy, he draws evidence from such historical cases as well as from four current occupations—Bosnia, Kosovo, Afghanistan, and Iraq—where the outcome is not yet known. Occupation is difficult, in Edelstein's view, because ambitious goals require considerable time and resources, yet both the occupied population and the occupying power want occupation to end quickly and inexpensively; in drawn-out occupations, impatience grows and resources dwindle. This combination sabotages the occupying power's ability to accomplish two tasks: convince an occupied population to suppress its nationalist desires and sustain its own commitment to the occupation. Structural conditions and strategic choices play crucial roles in the success or failure of an occupation. In describing those factors, Edelstein prescribes a course of action for the future.

Often, violent behavior or harassment from a soldier is dismissed by the military as unacceptable acts by individuals termed, “rotten apples.” In this study, the author argues that this dismissal is unsatisfactory and that there is an urgent need to look at the (mis)behavior of soldiers from a structural point of view. When soldiers serve as an occupational force, they find themselves in a particular situation influenced by structural circumstances that heavily influence their behavior and moral decision-making. This study focuses on young Israeli men and their experiences as combat soldiers in the Israeli Defense Forces (IDF), particularly those who served in the “Occupied Palestinian Territories” (OPT) during the “Al Aqsa Intifada,” which broke out in 2000. In describing the soldiers’ circumstances, especially focusing on space, the study shows how processes of numbing on different levels influence the (moral) behavior of these soldiers.
