This White Paper sets out the Government's proposals for a Marine Bill designed to establish a new UK-wide strategic system of marine planning to balance conservation, energy and resource needs, based on the principle of sustainable development and working with the devolved administrations. Key provisions of the proposed Bill will be: the creation of a new Marine Management Organisation (MMO) to provide a holistic approach to marine policy covering planning, licensing and enforcement issues; a more streamlined, transparent and efficient marine licensing system; new mechanisms to supplement existing tools for the conservation of marine ecosystems and biodiversity, including marine conservation zones for important species and habitats that cannot be protected under European law; and reform of the management of inshore fisheries and recreational sea angling, including stronger enforcement powers and the recovery of costs of fishing vessel licence administration.

The Committee's report welcomes the publication of the draft Bill (Cm. 5843, ISBN 0101584326) in June 2003, but states that civil contingencies legislation should have been introduced in the current Parliament (as recommended by an earlier Committee report (HCP 518, session 2001-02; ISBN 021500468X). Findings include the need for: the Government to explain why it proposes to create statutory civil protection obligations for local authorities and emergency services but not for itself or regional bodies; clarification of the emergency powers provisions to clearly establish safeguards against misuse of these powers; and further discussion on the provision preventing any special legislative measures being struck down by a court due to incompatibility with the Human Rights Act. The Committee also notes that, although it would not wish the Bill to be delayed any further, insufficient time has been allowed for the public consultation on the draft Bill, and the pre-legislative scrutiny process, to be conducted by a specially appointed Joint Committee, is also having to work to a very tight deadline.

The government proposes to give local authorities more freedom and powers to meet the needs of their citizens and communities. Local authorities will be encouraged to develop neighbourhood charters setting out local standards and priorities; to manage services at the level of the neighbourhood; to work more closely with neighbourhood policing teams. Local people will receive more information about services and standards, and will be able to question and get a response from local councilors through a new service, Community Call for Action. Executive power will be invested in the leader of the council, and there will be three choices of leadership model: a directly elected mayor, a directly elected executive of councillors, or a leader elected by fellow councillors with a four year mandate. New training opportunities will be provided for councillors. The making of byelaws will be fully devolved to local authorities. The authorities will be encouraged to bring together local partners to help improve services, and to develop a delivery plan - the Local Area Agreement - setting out a single set of priorities for local partners, for the Sustainable Community Strategy that they are already required to prepare. The performance framework for local government will be simplified: there will be about 35 priorities for each area, with a set of some 200 outcome based indicators replacing the many hundreds of indicators currently required by central government. Ambitious efficiency gains will be required as part of the 2007 comprehensive spending review. The second volume shows how these proposals will apply to major local public service areas and cross-cutting issues: community safety; health and well-being; vulnerable people; children and families; climate change; and economic development, housing and planning.

This Green Paper sets out the Government's strategy for housing based on three key objectives: more homes to meet growing demand; better designed and greener homes, linked to good schools, transport and healthcare; and more affordable homes to buy or rent. Proposals include: i) a new housing target of building two million homes by 2016 and three million homes by 2020 to meet growing demand and address affordability issues; ii) a £8 billion programme for affordable housing in 2008-11, a £3 billion increase compared to the previous three years, with at least 70,000 more affordable homes a year and 45,000 new social homes a year by 2010-11; and iii) an invitation process for local authorities and developers to propose five new eco-town schemes, with the entire community designed to be able to reach zero carbon standards, and each scheme could provide between 5,000 and 20,000 new homes. These proposals are to be delivered through a number of measures including: increased infrastructure support; reviews of regional plans; a new Housing and Planning Delivery Grant to incentivise councils to deliver high levels of housing and new guidance to help councils identify available land for housing; more use of public sector land and disused land to maximise development on brownfield sites; better use of existing buildings by bringing long-term empty homes back into use; and the creation of the new homes agency to provide expertise for local government in negotiating, brokering and partnering to underpin delivery.
