With the wind of economic globalization blowing across the planet, human rights are currently exposed to violations in great proportions by powers other than the State, including multinational corporations (MNCs). Unfortunately, many States - especially the developing countries, including Nigeria - hardly regulate the activities of the MNCs for various reasons, thus creating a regulatory vacuum. Under these conditions, the existing catalogue of civil, political, social, cultural, and economic rights of the people - as expressed in both domestic and international human rights law - are adversely affected by the activities of these MNCs. This book, developed from the author's doctoral/PhD thesis, critically examines: the various human rights violations and the environmental damage associated with oil exploration activities in the oil-producing communities of Nigeria; the international codes of conduct and norms; and the roles and responsibilities of the major MNCs in respect of these violations. Coming at a time when governments worldwide are striving hard to ensure corporate accountability for their activities in their host nations, this work is unique in that it incisively analyzes how the national and regional institutions could be strengthened to provide effective protection against human rights abuses and ensure corporate accountability. In an already fragile country as Nigeria, characterised by weak democratic institutions and poor economic governance, this situation has led to increasing discontent and violence towards both the government and the oil multinationals. These two actors co-operate for the maximisation of oil profits and revenues while, at the same time, excluding local host communities from the participation in the oil development projects, preventing them to achieve a sustainable development, violating their Human Rights, and compromising their livelihoods. This paper analyses the legal framework of Nigeria in the oil sector and the peculiarities of the country in order to provide a critical overview of the issues, demonstrating that the amendment of the domestic Acts dealing with the topic, as well as the remediation to the damages caused by the oil multinationals, are no longer deferrable. The final aim is to suggest a pattern to sustainable oil development which, by means of applying the concepts of Corporate Social Responsibility, would help to quell the conflict, to improve the standards of life of local people, and to make Nigeria emerge as a socio-environmentally responsible African resource-rich country.

A major new independent scientific assessment, carried out by the United Nations Environment Programme (UNEP), shows that pollution from over 50 years of oil operations in the region has penetrated further and deeper than many may have supposed. The assessment has been unprecedented. Over a 14-month period, the UNEP team examined more than 200 locations, surveyed 122 kilometres of pipeline rights of way, reviewed more than 5,000 medical records and engaged over 23,000 people at local community meetings. The environmental restoration of Ogoniland could prove to be the world's most wide-ranging and long term oil clean-up exercise ever undertaken if contaminated drinking water, land, creeks and important ecosystems such as mangroves are to be brought back to full, productive health. The report key findings are alarming both in terms of human health protection and environmental protection: some areas, which appear unaffected at the surface, are in reality severely contaminated underground; at least 10 Ogoni communities where drinking contaminated water; control and maintenance of oilfield infrastructure in Ogoniland has been and remains inadequate; the impact of oil on mangrove vegetation has been disastrous. The report recommends direct actions in order to address the Niger Delta contamination by oil and warns that the restoration of the area could take up years.
