Dopo oltre trent’anni dall’entrata in vigore della Legge n. 689/1981, non si può avere più timore nell’affermare che la funzione sanzionatoria amministrativa ha raggiunto una sua dignità strutturale idonea a ritenere che l’illecito amministrativo possa essere governato senza dover ricorrere ad istituti affini prelevati da altre branche dell’ordinamento. A dispetto di questo consolidamento si deve rilevare, tuttavia, che permane ancora una cospicua superficialità nel trattare siffatta materia: superficialità che attiene sia alla fase dell’accertamento delle violazioni che al modo in cui si affronta il contenzioso che ne deriva. Il presente studio, vuole mettere in condizione, chiunque debba cimentarsi con questa materia, di trovare risposte ragionevoli ad ogni problematica che si possa profilare, tanto sul piano dell’accertamento delle violazioni, quanto sul piano della aggressione ai vizi rilevabili da provvedimenti sanzionatori in sede giurisdizionale. Un manuale che ha una funzione bivalente perché orientato sia verso gli esercenti la professione forense che verso gli operatori di polizia; un’opera di spiccato contenuto pratico che non manca di quel necessario supporto teorico che è indispensabile alla piena comprensione e gestione degli istituti che sono alla base delle sanzioni amministrative che sempre più vanno ad occupare, in linea con le recenti politiche legislative di reazione all’illecito, fette più ampie di estrinsecazione della punizione pubblicistica. Giuseppe Napolitano, avvocato, dottore di ricerca in diritto amministrativo e specialista in scienze dell’Amministrazione, si occupa – fin dalla metà degli anni novanta – dell’illecito amministrativo, affrontando la materia sia sul piano teorico nel contesto del suo impegno universitario, che sul versante pratico, organizzando e gestendo la tutela legale pubblica delle sanzioni amministrative per conto di diversi enti pubblici. A tale esperienza si affianca quella di Comandante di Polizia Locale, idonea a comprendere e valutare le criticità insite nelle attività di accertamento delle violazioni punite con sanzioni amministrative.

In recent years "leaderless" social movements have proliferated around the globe, from North Africa and the Middle East to Europe, the Americas, and East Asia. Some of these movements have led to impressive gains: the toppling of authoritarian leaders, the furthering of progressive policy, and checks on repressive state forces. They have also been, at times, derided by journalists and political analysts as disorganized and ineffectual, or suppressed by disoriented and perplexed police forces and governments who fail to effectively engage them. Activists, too, struggle to harness the potential of these horizontal movements. Why have the movements, which address the needs and desires of so many, not been able to achieve lasting change and create a new, more democratic and just society? Some people assume that if only social movements could find new leaders they would return to their earlier glory. Where, they ask, are the new Martin Luther Kings, Rudi Dutschkes, and Stephen Bikos? With the rise of right-wing political parties in many countries, the question of how to organize democratically and effectively has become increasingly urgent. Although today's leaderless political organizations are not sufficient, a return to traditional, centralized forms of political leadership is neither desirable nor possible. Instead, as Michael Hardt and Antonio Negri argue, familiar roles must be reversed: leaders should be responsible for short-term, tactical action, but it is the multitude that must drive strategy. In other words, if these new social movements are to achieve meaningful revolution, they must invent effective modes of assembly and decision-making structures that rely on the broadest democratic base. Drawing on ideas developed through their well-known Empire trilogy, Hardt and Negri have produced, in Assembly, a timely proposal for how current large-scale horizontal movements can develop the capacities for political strategy and decision-making to effect lasting and democratic change. We have not yet seen what is possible when the multitude assembles.
